The SWAT team that gunned down a former Marine in his Tucson, Ariz., home was cleared today of any wrongdoing in the incident.
Jose Guerena, 26, was killed in a hail of bullets from the SWAT team, which broke down the door to his home on May 5 while trying to serve a search warrant as part of a home invasion probe.
Guerena did not fire a single shot in the incident, but Pima County Chief Criminal Deputy Attorney David Berkman said in the report issued today that the five SWAT team members were justified in using deadly force because the former Marine pointed his weapon at them.

Cops clearing cops of wrongdoing. Wow, didn’t see that one coming.
Prayers for this Marineand his his family. This is Americas loss
When will enough, be enough?
There will never be “enough.” This is a progressvce development and only goes in one direction.
ABC News was convicted today of a lack of journalistic integrity. This comes on their previous 50 years of lying to the American people and any other country where they broadcast. Sentencing awaits.
So, because the five swat team members pointed several guns at Guerena, he would have been justified in shooting at them, correct? Anyone can yell police and bust down a door. Under U.S. law, a man's home is his castle.
So the cops come to kick your door down in the middle of the night, you don’t know they are cops, you pick up your gun like every american gun owner would, and the cops now have the right to shoot you in your own home 61 times, even thou you never fire a shot?
Thugs with uniforms on. No different than street gangs, just better armed and trained.
Excellent question.
After suffering through the Waco hearing whitewash, I have not faith this “fast and furious” hearing show will be any different, yet some on here call me cynical.
I guess they were just kids back in the 90’s.
Our government had that whole decade to stop the disease of corruption at the federal level and it was an epic failure.
And that was with a republican congress.
History always repeats itself, so we probably should start doing a little research to see how resistance fighters coped with the Gestapo during World War II. It would probably also be beneficial to establish an historic time line for determining the interval between killing citizens in the home and the nightly disappearances of suspected resistance members.
Above is the most important quote in the article.
Did he? Or did the 'boys in blue' say that he did? I'd like to see proof of that.
And really, why was a SWAT team sent out in the first place? Was someone's life in immediate danger?
Build one of these:
Obama’s army. He promised it!

Is Pima County Chief Criminal Deputy Attorney David Berkman a cop?
