A business plaintiff in the legal challenge to Obamacare said opponents had "a good day" at the 11th Circuit Court of Appeal on Wednesday.

Presiding over a packed courtroom in Atlanta, a three-judge panel heard oral arguments from both sides over the constitutionality of the Affordable Care Act.

A coalition of 26 states, led by Florida and the National Federation of Independent Business, argued that the ACA's mandate requiring the purchase of health insurance was an unprecedented overreach of federal power.

Attorneys for the U.S. Justice Department countered that the program is constitutional, but they ran into skeptical inquiries from the panel.

"Lawyers on both sides believe the matter ultimately will be decided by the U.S. Supreme Court -- possibly after the 2012 election -- but the appellate panel's ruling in Atlanta is viewed as a crucial test. Observers expect that the panel could take several months to issue its decision."

If the government can force us to by health insurance, what is to keep them from saying each family must own a Volt?

Attorney General Pam Bondi Issues Response to Oral Arguments on the Constitutionality of the Federal Health Care Act

TALLAHASSEE, Fla. – Attorney General Pam Bondi issued the following statement after oral arguments were heard this morning by the 11th Circuit Court of Appeals in Atlanta, Ga. in Florida’s challenge to the federal health care law.

“I am pleased with the oral argument. The judges were extremely well prepared and engaged, and our attorney Paul Clement, did an excellent job.

“The federal government could not rebut our argument that the individual mandate is an unprecedented intrusion on individual liberty. The federal government could also not articulate any principled limit on Congress’s power. Simply put, the federal government failed to justify Congress’s decision, for the first time in American history, to force citizens to purchase a product.

“I am encouraged by the judge’s response to our arguments that the health care law’s Medicaid expansion unconstitutionally coerces the states by forcing them to assume billions in uncompensated Medicaid costs. The health care law vastly exceeds Congress’s legitimate authority.

“I hope for a prompt decision from the 11th Circuit Court of Appeals and look forward to a final resolution by the U.S. Supreme Court as soon as possible.”

Nice to know but (I suspect) it means nothing in regard to their decision.

Still, nice.

Why the heck does it take over a year to make a call on this...is it because these Judges don’t know the law and have to study up on it...it’s either constitutional or it isn’t...damn...this is beyond my comprehension.
If the convenient store clerks gave change in like the Judges decision making policies...I would still be in line paying for .38 cent per gallon gas.

Thanks. That is encouraging. Sadly, when it gets to the Supreme court it will still be a 5-4 decision.

If the government can force us to buy healthcare, in violation of protections under the constitution, what can’t they force us to do?

Also if Government can order us to purchase health insurance or pay a penalty (fine) then we are under a dictatorship. We are on the edge of a dictatorship. The raid on our oil production in America will continue and if the cost gets to 5 dollars a gallon and the inflation continues a civil war will begin.

Mark Levin is saying that it DOES APPEAR THAT AT LEAST 2 OF THE 3 JUDGES KNOW WHAT IS GOING ON.

Pretty scary stuff.
Back in the 80’s, you would never have seen someone create a personal symbol for their Presidency, you would never have seen kids dancing and singing praises for dear leader.
Only in a communist dictatorship would you see such worship of a cult of personality.
And if you’d told people back then that in a little over 29 years they’d see just that, they’d scoff at you and tell you that you were stupid.

I am tired of the American people being punished for not being crooks, liars and thieves by crooks, liars and thieves.

The federal government could also not articulate any principled limit on Congress’s power.

So FedGov gets to set its own limits of power and authority?
Silly me; I believed that Article I Section 8 already did that!

If they can require purchase of health care, they can require a gym membership and all manner of other stuff.
