Several states have their own militia. Texas is one.
Has there been any talk of calling up the Texas militia? If not, why not?
In my state, we have a Sheriff's Reserve. At one time, it was a true police force, and it was called upon to quell riots in the late 1800's.
Now our Sheriff's Reserve is essentially a social club that goes on parade once a year. Could today's Texas militia be like that? I hope not.
And to MindBender26: Thanks for the info. IMHO, the Militia Act of 1903 was a terrible law. It gives way too much power to the federal government. It should take a congressional Declaration of War to federalize state troops.
All States have their own Militia, there is the Militia which the Feds pay them to keep(the National Guard) and various volunteer and state supported militia.
In terms of the National Guard our States Need to retake control of their guard units by aggressively asserting their rights to choose the officers and conduct the training.
Letting the Feds mobilize their own guards against them is a sign of sheer stupidity and fatal incompetents on the part of State officials.
The whole point of Article 1 Section 8 Clause 16 is as Alexander Hamilton put it in the Federalist papers(no. 29, 181—87):
“If it were possible seriously to indulge a jealousy of the militia upon any conceivable establishment under the Foederal Government, the circumstance of the officers being in the appointment of the States ought at once to extinguish it. There can be no doubt that this circumstance will always secure to them a preponderating influence over the militia.”
