You seem to making the case that any foreigner could impregnate a US citizen and provided that citizen were to give birth on US soil, the child could run for POTUS thirty five years later?

So logically, Hugo Chavez could have a dual citizen child born in US prepping for POTUS???

Everyone knows the founders were only concerned about King George’s oppressive genes. /s

Ever wonder why the Founders used the word natural? Kind and Natural have the same meaning.

Vattel uses the naturels..take a few moments..research the etymology of Kind..

You will find the answer.

The requirement for "natural born" in the U.S. was enough. They didn't ~need~ to require that their parents were also born here.

Natural born requires both parents to be citizens, whether native born or naturalized, at the time of birth of their child. I haven't seen where the parents must also be natural born.

In Hamilton’s original draft, the constraint was that the President had to be “born a citizen.” In response to John Jay’s criticism regarding the need to prevent the Commander In Chief from having any foreign allegiances, loyalties or conflicts of interest, the constraint was changed to “natural born citizen.” So “natural born citizen” MUST be more restrictive than “born a citizen,” and must be so in ways that address Jay’s concerns.

You seem to have a very selective interpretation of the Constitutional Convention. When Jay wrote this, a committee had just been formed to create a draft of the Constitution drawing from the agreed upon proposals from the various state plans. Hamilton's plan was only one of several and was dismissed by the time Jay wrote the letter. You have to read Jay's proposal in the context of plans such as the Virginia Plan, which was more abstract and didn't get into specifics regarding eligibility.

I must respectfully disagree my FRiend. Natural born citizen is clearly a higher category of citizenship required to be president of the country, otherwise why would it have been specified as such in the constitution? As understood at the time of the founding, natural born meant the issue of citizen parents who would have no divided loyalties. Conflating native born with natural born does not make sense because that would make US-born children of illegal aliens eligible for the presidency.

This issue really cries out for a definitive SCOTUS ruling but unfortunately it is always too hot to touch or too cold to be of interest to them.

I agree. It would be insane to think that if you serve in the military and are stationed overseas with your family that you are required to sacrifice passing on NBC status to your children should they be born in another country. It is not where you are born but the citizenship status of both your parents when you are born. Both parents citizens? Then you are a NBC.

I’m sorry but you’re just wrong. There’s been so much misinformation paraded as true in this unending debate, people of good will are becoming confused. There is no such thing as “native” born in the law. There is citizenship by birth and there is citizenship by statute(naturalized) and that’s it.

And yes, technically, a child born here to illegal immigrants could in fact be eligible to run for President. I don’t like it, but that’s the law.

I have no doubt that if they were to define natural born citizen, they would decide on something even more liberal than the commonly-held definition of being born on U.S. soil. By that I mean they would include everyone with citizenship at birth, including those born overseas.

The idea that they would make it significantly more strict, thereby invalidating the Obama presidency, is nothing more than a pipe dream.

For what my non-expert opinion is worth, I thought “natural born citizen” must mean something more than “a citizen at birth” as well. As far as I’m concerned, Obama is the first US president since William Henry Harrison, with the possible exception of Chester Alan Arthur (I believe there is some doubt), to be entitled to British citizenship at birth. He was entitled to Kenyan citizenship until age 18 under internationally recognized laws as well, I believe.

Being born with a dual allegiance would seem to defeat the natural born citizen concept. Relying on “anchor babies” for a candidate whould just take longer.

(Then again, what if some other nation tried deliberately to play havoc with our laws? What if, say, Iran passed a law stating that all nom-Muslim Americans born in the US were entitled to Iranian citizenship at birth? Would that make all non-Muslim Americans ineligible for the presidency? It should not, of course - and no other nation would recognize that law.)

I agree with your definition of natural-born citizen. But the matter is not free from doubt, and no one in authority raised it before the election. I can’t conceive of any negative consequences to Obama, if the facts are as stated in the long-form. That’s not necessarily what should be, just what is. If I’m wrong I’d be delighted to see the provision enforced.
