This was definitely premeditated. After he put the crook down, he went outside and emptied his weapon into the air. Then he went back inside, past the unconscious crook, went looking for another weapon, found it, walked back over to the unconscious crook and shot an unarmed, unconscious man five times when he thought no one was looking.

Then he lied about what he did.

Nothing that happens in trying circumstances can be described as “premedidated”. Did he plan it days, weeks, hours ahead? Did he plan it?

I respectively disagree. He did not wake up that morning with murder on his mind. He was put in a situation that hopefully you and I will never be put in. I don’t know how I would react. Do you?
