A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.

The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.

The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

I’m calling this drug dealing dirt bag a former fricking Marine.

Since he is dead and can't speak and there has been no trial, how do you know he's guilty of dealing drugs?

“You are truly scary! I’d almost suspect that you either belong to a SWAT team like this or are LEO. You believe that you are both judge & jury and convict this INNOCENT man. “

Wrong on both accounts. But, you act like it is a negative if one is a member of a SWAT team or police. That’s is jaded...and you’d be the first to whine when you were carjacked, robbed or taken hostage.

I should have been more specific - a rogue cop! I’m sorry, but I think that 70 shots to take down 1 person is absolutely unacceptable! It seems that you have no problem with the cops in this case imposing the death sentence on an innocent man! That’s tyranny.

Yeah, he was the subject of and part of a 4 house warrant, sirens go off and dozens of SWAT are at your door and you present a rifle.

yeah...he was innocent.

Please direct me to the court papers pronouncing him guilty of any crime. Oh...that’s right....they don’t exist. Even having a gun and using it are two totally different things. He didn’t shoot at anyone......yet you pronounce that the death sentence was warranted. You’re truly deranged and as I said in a former post - Very Scary!!!

What if the training and "special tactics" are what's wrong?

Did you watch the video. The "siren" sounds like a car alarm and muffled the officers shouting "police".
There is no reason why they can't have a working loudspeaker and have someone say "This is the police. We have a search warrant. Please lay down any firearms".
Instead we have a group entering in such a way as to cause maximum confusion. That's all well and good if you want to neutralize the person inside.

“Please direct me to the court papers pronouncing him guilty of any crime.”

That is such a contorted bit of pretzel logic. All he had to do was comply and he would have had his day in court. Mussolini wasn’t proven guilty either. Does that mean that he was NOT guilty. No.

“having a gun and using it are two totally different things. He didn’t shoot at anyone”

Try to wrap your silly little brain around the context of the situation....you know warrants for illegal activity, suspected to have weapons (It’s the combo of these two that kills the dufus)

“yet you pronounce that the death sentence was warranted.”

Nope, it’s just what happens when you F up. He F’d up.

The video was taken from a helmet camera of one of the officers. I can also hear music in the background. I did see one version of the video where the announcement at the door was very loud and clear. Perhaps it was enhanced by someone at the TV station that hosted the video. My point is the audio pickup on the helmet camera may not be that good.

“You obviously don’t have a clue about Marines, there are no ex-marines. Only a prancing fag lawyer with his pocketbook worries would even say such a thing.”

My son-in-law did two tours in Fallujah in the USMC Infantry. He calls himself an ex-Marine. I reckon that is his right.

Was the border agent hat the “part of a law enforcement uniform” that was found, or is this more disinformation?

E-bay: $8:95.

Maybe e-bay will tell you who is buying them, so you can hunt them down yourself and kill them.

They left him without medical care for an hour and a half.

MURDER.

They wouldn’t have left one of “their own” lying there.

I like what “HFR” posted on another thread:

“What I’m hearing about the video is that it is prima facie evidence that the swat team should be indited.
The standard operating procedure - following the rules, itself constitutes prima facie evidence that what we have here is a violation of civil rights. These procedures, fitting for a battlefield assault on enemy lines, have only a very tiny justification in only the most extreme situations.

1. Perfunctory announcement.
2. Immediate breaching of the premises.
3. Immediate violent and deadly resort to weapons.

These things show themselves to have no place in a Constitutional republic.

A warrant for this type of action should only be issued upon presentation of compelling evidence that a crime of horrific dimensions exists.

Ostensible reasons like “preservation of evidence” or other canards cannot justify this.

To repeat what I said, that this is a “standard operating” procedure instead of a desperate last resort in the face of monstrous crime, is prima facie evidence that the people who have designed and planned this kind of police activity should be indited for crimes against our Constitution. As for those who carry it out, Nuremberg’s principal applies, following orders is not a justification for doing wrong.

The other day there was a post about Thomas Jefferson, it gave a number of examples of his thinking - very pithy quotes. How far have we fallen from our ideals. But when we let “experts” run the show that’s what we get. It is an axiom that war is too important to be left to generals. I’d add that law is too important for lawyers, policing is too important to leave to police, government is too important to leave to politicians and bureaucrats, on and on. The only people the Founders trusted with their liberties, and the preservation of the same was the “People”. The Bill of Rights indicates that the Founders did not trust their liberties to the “representatives of the people in congress”.”

And it was supposed to be better, inside the house with the car alarm, er siren going off?
Bad tactics unless the goal is to neutralize the target with all force, including lethal. Preventing violence isn't the goal.

At :17 you hear (one of the cops?) say “bang bang bang”...as they’re walking up to the door. What’s that all about?

And why didn’t those idiot cops put the guy with the helmet cam in FRONT, where it would have shown everything that happened?

I also like what Gene Eric said on this thread.

“The judiciary has gone off the rails. What judge issues a warrant for an assault team to descend on a family of young children?”

But keep defending it, you Statist idiots!
