A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.
The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.
The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

O, OK. So you point a gun at them when they bust the door down. That’s smart. Because you ALWAYS have superior firepower over criminals, and cops are obliged to wait until you actually shoot them?

They used to save the full auto gun-downs for foaming killer maddogs. When authority reaches this level of loathing and arrogance and contempt for the citizen and his Constitution there is only one way to set things back. Yep, you guessed it.

If the raid and shoot were legitimate, and the suspect can't even talk and is in fact dead, what exactly are they afraid of?
Correction - “If youre ever questioned by the police about anything, lawyer up.”
There are reports that this was but one of four houses raided with warrants, involved in a drug gang.
There were large amounts of cash and drugs found in the overall operation...it didn’t say which of the 4 houses had what.
But that is irrelevant as they were all part of the investigation.
So he had something to hide, lets say thats true. Does that mean the cops can engineer a situation to be highly dangerous with a highly predictable outcome. The cops action results in the death of someone who has a history of being a stand-up solid American and who also has not been charged with a crime let alone convicted?

That’s like Colenol Mustard saying, “You consider someone with a candlestick a criminal.”
Out of context, no, it is legal to own a border control hat, even an official one. (And I did find on the internet that they did find such a hat.)
Out of context, the guns are also no indicator of criminality. Or the body armor. Or is the photo of Jesus Malverde. Or the stashes of cash. Or the fact that someone had been posing as a law enforcement officer to raid neighborhood homes. I was perfectly inclined to believe that even the fact that he was pointing a gun at a SWAT team was simply a foolish decision that resulted in a tragedy. Or that his wife hadn’t meant to make false statements to the police when she claimed that they hadn’t run a siren.
Any one of these could just be happenstance.
Together, it doesn’t look good.
Meanwhile a conga line of millions of illegal Mexicans enter with thousands of *tons* of drugs every year, all while the government winks and nods.
I’d say it helps confirm that their lead was valid. No reason to kill a guy. Unless he’s pointing a gun at you. Like he was.

It probably wouldn’t matter. If I had a gun in my hand, I’m pretty sure the average SWAT team would see me pointing it at them, just as this SWAT team reported that the guy fired first, and they had the bullet holes to prove it - except they did NOT.
My timeline for when the guy would reach the end of the hall gives what I think the earliest time would be, not the latest. How long does it take you to get out of bed, grab a gun, tell your wife and child to hide in the closet and then reach a spot where you can see your front door?
From the first siren/car alarm starting to first shot was, IIRC, 34 seconds.
I figure that at the fastest, he would have arrived at the end of the hall about the time the door was starting to be forcibly opened (26 sec). I don’t think he would have had a chance to look out the window and see who was there, or even to be in the same room at the time they said they were cops. He could well have arrived simultaneously with the first shots fired.

In the Costco shooting last July, the cop who opened fire said the man pointed his gun at him - but the gun was found holstered, no round in the chamber (which means he would have had to remove the gun and rack the slide to get ready to shoot).
If the cops broke down my door and found me standing with my revolver hanging down at my side, do you really think they wouldn’t shoot? 71 rounds fired in 7 seconds...does that sound to you like they are trained to think first, shoot second?
Oh we see. When the Marine got off duty from his 12 hour shift at the mine.....he kicked in doors as a home invader. Pfffff.......

Well, if you actually DO lower it, yeah, I think cops would notice the difference between a gun pointed at them, and one not pointed at them. Also, shouting, “Don’t shoot; I’m putting down my gun” probably helps, further. And I also have no difficulty believing that someone on the team mistakenly believed that the vic shot first; once the first bullet flew, he started shooting.

So because one cop is guilty, all cops are guilty?
God, no. Of course not. No-one who has to work long hours at menial labor ever could decide he wanted more money, even if it meant doing something illegal. And law enforcement, having the memories of goldfish that they do, couldn’t possibly have been serving a warrant to investigate a crime which happened on a previous day (/sarc)

Nope. That’s not what I’m saying.
From the moment I learned that the cops fired upon a man who did not fire on them, I have questioned the cops actions. (this would be before it made it onto Freerepublic though I have posted a wad of the news stories about this subject.) I have repeatedly stated that the cops could have searched this house with no problems while the husband was at work. If the victim was a problem, they could have stopped him anywhere between his workplace and his home without any issues. The cops are all over the area where the victim lived, and it’s not exactly a high traffic area. But the cops all over the area aren’t SWAT members.
I haven’t read whether the other houses were raided using SWAT vehicles. I wonder how many SWAT vehicles Pima County has.

Factually incorrect. They are cops. The man they killed is a former Marine (despite the saying, factually), they killed him on a warranted drug search in which he had a weapon in his hand.
