Dramatic footage shows moment Iraq war vet was shot 70 times in home

A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.

The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.

The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

At the point she was detained, and no longer free to leave, she was read her rights by the homicide detectives. The transcript of their interview has an extensive Miranda discussion, both in English and Spanish. She professed not to understand, and the warning was re-explained repeatedly.

Nevertheless, if you read it, you’ll see the knowing waiver issue would be a close call in the event of a criminal prosecution.

NOt these days. THe villain of this piece is the no-knock warrant. The whole concept needs to go, with no excptions whatever. IF this interferes with drug enforcement, so be it. I would rather have junkies living on my street than give law enforcement monster powers like this.

The police first stated the warrant was issued relating to drugs, marijuana to be exact. Now the warrant is sealed apparently from what I am reading here at FR.

So they busted in his front door loaded for bear because he may have had an illegal plant, which he didn’t? Then they shoot him 60-70 times and prevent him getting any medical help.

This is not a justified police action on any account, it is poorly trained SWAT at the least, executioners in uniform looks more likely. They had shot the guy 60+ times in the front hallway and did not secure the rest of the house immediately as they are trained to do? BS to the power of 10!

Combination of hysteria and language problems. Certainly understandable. She made that statement in the phone call to her friend, actually switching to Spanish for part of it. Still, my point is, there was no consistent story in the interviews.

At the moment, there's a lot of individuals throwing around a lot of scenarios that are mutually contradictory. If it was a drop gun, then extolling him for having the safety on makes no sense, etc. The key to understanding the event is to find a scenario that actually matches all the facts, then make conclusions from that. Many of these posts start with conclusions, then try to make selected portions of the facts match them. It's a great rhetorical exercise, but not much good in pursuing truth.

She was not free to leave at any point. The first questioner repeatedly told her, I don’t think you can go over there. I will talk to your m-i-l for you. I will talk to Gracielita (sp?) for you. Etc. And yet they recorded her side of a phone conversation with her brother-in-law’s wife? or girlfriend? This is all after they had beat her up.

That begs the question, if he knew it was the police, and he was an alleged violent dangerous criminal who knew he was going down, why did he not start shooting through the windows, door etc, and or at least get one round off when they busted down the door?

I have no doubt that there will be a lawsuit; and I might be happy to discover that the finding is against the Pima County PD.

I used a criminal lawyer to do a title search when I refinanced my mortgage. There was a recession on and he needed the job. There's currently a recession on and this guy works in AZ which has a very high level of housing defaults.

He may need the work ~ as simple as that.

Even the mob is not immune from economic conditions

No, it doesn’t beg that question. He could actually be innocent, and have behaved foolishly. But if he were innocent, and he thought his home was being invaded by criminals, would it have made any more sense to have greeted the invading criminals with a gun with the safety on?

If this is all a police conspiracy, why move the body, but leave the safety on? Why would the sheriff “confess” to the safety being on, at the same time he was perpetrating the cover-up.

My position is that this is a tragedy, involving a potentially innocent man who responded in a very unfortunate way to police, who in turn responded in a very unfortunate way. And as I’ve said before, I’m all ears for proposing reforms to prevent this sort of situation from happening again. You can bet your last dollar that the Tucson police will also be, after they get sued for $150 million, even if they defeat the suit. But screaming that the cops are all murderers doesn’t help that cause.

Grasping at straws. The guy is one of the most powerful criminal defense lawyer in Arizona, and his current client is a sitting mayor of a fairly major city, who’s facing many, many counts. I could see if one of the tadpoles from his firm got the job, but this one is getting the big fish.

Who said the cops were out to commit murder? Every post on this thread said the department was a bunch of untrained, high ego, wannabes that could not take on a paintball team. They screwed up and are now lawyered up, at the expense of the tax payer. Re-read the thread.

They get the top guy for 10 minutes and then the little guys do the work.

If it looks like the prosecutor has some stuff with staying power the top guy will be back.

BTW, the guy I had do the title search worked for Edward Bennett Williams (who also owned the Redskins, and had Greg Craig working for him at the time as a kind of personal harrassment expert).

The top criminal lawyers cast as wide a net as possible serving all the clients they can WHO PAY.
