Lawmakers Demand Explanation From White House as Libya War Deadline Arrives

The deadline for President Obama to secure congressional authorization for the military operation in Libya went whizzing by Friday without such a vote, fueling lawmakers' concerns that the administration was flouting the law, but the White House insisted it was on solid legal footing.

The concerns stem from provisions in the 1973 War Powers Resolution. The resolution, passed in defiance of then-President Nixon at the tail end of the Vietnam War, states that presidents must seek congressional approval to keep U.S. forces in hostilities for more than two months. Friday was the 60th day of U.S. involvement in the U.N.-backed military intervention in Libya.

Asked about the requirements in the law, White House Press Secretary Jay Carney cited the president's ongoing consultation with Congress and claimed his actions "have been and are consistent with the War Powers Resolution." He said the White House would continue to consult with Congress, adding that the administration would "welcome an expression of support" from lawmakers.

This is from the War Powers Act:

c) The constitutional powers of the President as Commander-in-Chief to introduce United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, are exercised only pursuant to

(1) a declaration of war,

(2) specific statutory authorization, or

(3) a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.

So WHICH clause is President Soebarkah bin Ubama acting under?

Clause (1): He never got a declaration of war from Congress.

Clause (2): There is no specific Congressional statutory authorization passed to authorize the Libyan attack. Leftists claim that a UN resolution is the same thing legally as a Congressional statute for purpose of this clause but that is false.

Clause (3) There was no national emergency created by an attack on us by Libya. The US and Libya long ago resolved the terrorist attacks against us in the 1980s, like it or not.

He used the US military to launch an attack using hundreds of missiles and bombs into the territory of a country not at war with us that destroyed about 20% of the entire Libyan military capability according to the pentagon. That was an act of war against Libya under anyone's definition.

This was illegal from the git-go, and Congress should be impeaching him for the high crime of malfeasance of office by violating the Constitution.

The neocons on Fox News and talk radio love this. But any “conservative” on FR has no right to complain, either. You justified this. I hope your children don't get killed because perpetual war is the surefire votegetter for both parties now.

Agreed. 0z-ama and most of those in DC don’t follow law, especially USA law, they do whatever they and their NWO organizations please. Our forefathers would be buying tar, rope and feathers and appling them to those who are part of this ongoing criminal activity.

Only lawful people follow law, and the DC lawless use the full extent of the law against the lawful whenever they can. We the (lawful) people are the only criminals now.

So when is Obama going to proclaim himself dictator? He has no opposition; nothing at all to stop him. The Democrats pay absolutely no attention to laws. The Constitution is but a meaningless piece of paper for them. Shades of Adolf?

Barky's just following the Slick Willie precedent. Slick started a war with Serbia designed to make the Serbians turn over Kosovow to Muslims (It worked. Thanks a lot, Slick), and Clinton never bothered with the War Powers Act.

Of course, both Barky and Slick have lapdog presses. Congress during the Serbian War was scared (it was post-impeachment failure), but what is the current Congress' excuse?
