Unfortunately, presidential qualifications are a “loophole” in the constitution.

The best way to describe it is to look at the 18th Amendment, prohibition. When it was passed, it had no effect at all, until congress passed “enabling acts”, laws, to carry it out. But by then they had seen the errors of their ways, so passed very weak laws.

In the case of presidential eligibility, the congress has never written any enabling act for it. Nobody is responsible for it, and there is no penalty if it is not obeyed. Still, the only way to remove a president, once elected by the Electoral College, is via impeachment.

This, in combination with the 1810 Marbury v. Madison decision, where the Supreme Court ordered the president to comply with their order, and he refused, does in effect put the president “above the law”.

So he, personally, cannot be restrained.

All that can be done is to restrain his authority.

To require that his orders must go through cabinet officers and others approved by the senate, who themselves can be impeached, though only one cabinet officer ever has been.

So impeach him for his crimes. If repubs had guts, they’d be talking about this. The fact that they are not means they have no guts.
