Stop trying to turn this guy into a helpless victim.
He’s an adult who made some bad choices...but they were his choices to make, and he paid the price.
Looking at this from the perspective of military justice, what LTC Lakin did was less important than how he did it. He could have done all sorts of things that would have made the military more sympathetic to his undertaking, but he broke a cardinal rule: under no circumstances do you miss a military movement.
This doesn’t make sense to the civilian mind. But from the military perspective, it is a very bad offense. Article 87. It changes everything. In past it could get a soldier hanged.
Any person subject to this chapter who through neglect or design misses the movement of a ship, aircraft, or unit with which he is required in the course of duty to move shall be punished as a court-martial may direct.
Maximum punishment.
(1) Design. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 2 years.
(2) Neglect. Bad-conduct discharge, forfeiture of all pay and allowances, and confinement for 1 year.
To explain. Article 87 assumes all sorts of truly awful reasons for missing a military movement. If a single soldier successfully “jumps ship”, it is seen as a terrible blow to unit morale and cohesion, and may inspire others to do the same. It is close to an act of mutiny and desertion. It may be based on the efforts of foreign agents working for the enemy, or a domestic conspiracy against the military action.
This is why missing a military movement is severely discouraged, and cost him any military support.
The LTC could have continued to protest, as long as he shipped out with his unit. But he made the fatal error, from which there is no recovery. His protest will be ignored, and will now achieve nothing.
In a way, he is much like Private Eddie Slovik, who deserted his unit when Army morale was low. So it was decided that he should be made an example of, by hanging. Yet fate intervened with the German war crime of the Malmedy massacre.
Because of this, morale went up, because it showed soldiers that if they were captured, they might be shot. So Slovik was approached with a deal. “If you say you were separated from your unit, you can go back to them with no hard feelings, and serve out your tour. But if you keep insisting that you deserted, we will have to hang you.”
Slovik decided to be stubborn and insist that he deserted, and if given the chance he would desert again. Some people are very dumb.
So they had little choice but to hang him, even though it was unnecessary.
LTC Lakin could have done all sorts of things, and truly been a thorn in the side to Obama. Instead he goes to military prison and loses his retirement.
I agree with for the most part with your assessment of Lakin but Slovak was shot by a firing squad, not hung...
Everyone else in the armed forces is a traitor, and the only patriot is Lakin.

I’ve been hard on Lakin for pleading guilty instead of sticking to his guns. But maybe that was unfair, since he was obviously set up by his lawyers.
