How is it legal to cause a fire in a public place?

Apparently the hippies are burning the flag in solidarity with the guy who stole and burned a flag last week:

He burned this flag the night it was announced UBL was dead. The flag burner is a self-proclaimed Communist. Hippie stoner type.

Koran burn = national press.

American flag burner = local news only.
