I think you’re absolutely right. If they actually ended up searching the car and found “something” whatever that “something” was might be inadmissible in a court of law. And I suppose they could try to sue the police claiming they were illegally detained. But “Protestus Interruptus” is quite a bit short of and less lethal than what many of us feel these folks have been begging for.
