Arizona Ballot Access Law vs Brewer's Excuse for Veto

Governor Brewer's "I do not support designating one person as a gatekeeper to the ballot for a candidate" doesn't hold water.

Under current Arizona law, the Secretary of State is the sole and solitary gatekeeper of the "qualification check" function, for those who seek the office of president of the United States.

Arizona Statutes: 16-242. Qualifications for ballot; nomination paper

A. A person seeking nomination as a candidate for the office of president of the United States shall sign and cause to be filed with the secretary of state a nomination paper ...

C. Section 16-351 does not apply to a nomination paper filed pursuant to this section.

D. Within seventy-two hours after the close of filing the secretary of state shall certify to the officer in charge of elections the names of the candidates who are qualified for the presidential preference election ballot.

The simple removal of paragraph "C" from the Arizona ballot qualification statute, 16-242, would enable challenges to qualification to be heard in a court of law, with whatever evidence is required to satisfy the judge.

B. Any elector [voter] may challenge a candidate for any reason relating to qualifications for the office sought as prescribed by law, including age, residency or professional requirements, if applicable.

From the post you linked, he used slightly different language.

He says "i do solemnly swear he is a natural u.s. born citizen"
It seems nitpicky to differentiate between "natural born citizen of the US" and "natural born US citizen," but it is probably error to assume the two are identical as a matter of law.

The second incantation can be argued as using "natural born" as an adjective against "US citizen." It inclines one to adopt the fairly popular (but IMO, fatally flawed) legal approach that everybody born on US soil, regardless of the national allegiance and citizenship of the parents (except diplomat's kids), is within the group the constitution calls "natural born citizen."

On the Candidate Nomination Paper, Obama certified he was a “natural born citizen of the United States.” The wording you noted was part of a blog post, not the actual wording on the certification.

Thanks for pointing that out. I went back through the links until I got to the copies of the papers filed at the AZ and NH state election offices. Indeed, he swore that he is a natural born citizen of the United States.

I heard Brewer's lame excuses on the news last night. The woman has confirmed to me that she has no business being governor. How'd she get this far?

I could see vetoes for both bills, if she had articulated these objections: (1) "Birther Bill" -- it doesn't address the 'natural born' requirement for candidates running for president of the United States; and (2) "Guns on Campus Bill" -- it does not allow guns in classrooms...what's the point?

These objections I might have sympathisized with, but not the inarticulate, sorry excuses she gave. Is her brain burned out from alcohol? What's with her halting disconnect twist brain and lip?
