Madison Dane County Circuit Court Judge Maryann Sumi on Thursday dismissed a lawsuit over a controversial plan to limit collective bargaining for public employees.
Sumi's order dismissed the suit by Dane County, Acting Dane County Executive Kathleen Falk and Dane County Board Chairman Scott McDonnell. Falk and McDonnell were dismissed in their official capacities, but may be able to continue the suit as private citizens.
The case is one of three against the collective bargaining measure. Sumi has blocked the law from being implemented in one of the other cases.
Sumi found that Dane County, as an arm of the state, is barred from suing the state. Likewise, Falk and McDonnell are prevented from suing in their official capacities.

Which means she’s read the petition to the Supreme Court and is trying to clean up some of the errors it points out in order to bolster her tactical position. It won’t work.
I dunno what her thinking is, since she seems to be ignoring the law and making it up as she goes. Maybe she just doesn’t like Kathleen Falk.
Sumi put all of her eggs in the Kloppy basket and they all broke.
Hmmm. No ruling on the substance, just on the process. This is not a win for either side.
