St. George Tucker explains that three quarters of the meaning of the Constitution comes from our common law. James Madison, quoted by Mark Levin in Liberty & Tyranny, p37 “I entirely concur in the propriety of resorting to the sense in which the Consittution was accepted and ratified by the nation. In that sense alone it is the legitimate Constitution. And if that be not the guide in expounding it, there can be no security for a consistent and stable, more than for a faithful exercise of its powers...”
There is no evidence that anyone knew of Chester Arthur's ineligibility. There is evidence that Arthur concealed it, and misdirected the public by hiding his birth records - he was born in Vermont - but had a likely ally, Hinman, write a book alluding to Arthur's having been born in Canada. It served Arthur's purpose to have the press and public search for a hidden birth certificate.
Arthur had all his personal papers burned just before a death he was anticipating. It seems that Leo Donofrio and his sister are the first to have paid attention to the naturalization papers of Chester's father, among the remaining personal documents in the possession of a biographer of Arthur. Even the biographer, a very thorough historian, hadn't noticed the discrepancy.
Besides the extensive research, much of it original, in rxsid’s natural born citizen research thread on Free Republic, Leo Donofrio who opened the door to the real Constitutional issue, has re-opened his site, and Mario Apuzzo and Charles Kerchner have both addressed every issue we are discussing here - and should continue to address to help others understand.
Please keep up the excellent analysis. We all need to become teachers. There should be no egos. Our framers really did anticipate, and attempted to filter out, presidents with alien allegiance. It is hopeful that rxsid has an opportunity to explain to Trump's team the subtleties of natural born Citizenship. It would be good to recognize the most determined warriors for truth, Charles Kerchner, Mario Apuzzo, Leo Donofrio, and yes, Orly Taitz. Taitz, perhaps not so sophisticated in her legal reasoning, exposed the Berg subterfuge, explaining what we are now discussing, two and a half years later, that Kenyan birth, while if proven, would further clarify Obama’s ineligibility, his British father was sufficient proof that he was not eligible, not a natural born Citizen. She knew the meaning of natural born Citizenship (see her Dec 2008 press conference in Wash. D.C. with Berg). Taitz, seeing the futility of seeking redress in a politicized judiciary, ran for Secretary of State, to be confronted by a fraudulent opponent who was protected by the current Sec of State. Taitz exposed the value of Soros' Secretary of State Project. Dr. Lakin, while he appeared not to grasp, or didn't speak of, Obama’s alien birth - born a British Subject - he put everything on the line as true warriors do. The more we can make the legal certainty of natural born Citizenship violation clear to the public, the sooner we can force resolution. Obama never cared, and must have another path plotted for his future. He may be counting on the total dissolution of our Constitution, and may have a another country of residence established. But remember, Obama never told us he was a natural born Citizen. He told us he was a Title 8 Citizen, "A native born citizen of the U.S.", which is probably true. He has been permitted to stay in office by a corrupt legislature and judiciary - a very sophisticated operation. While others see the impending destruction of our economy as the primary concern, I believe we can rebuild the economy, but only if our society honors and defends the Constitution.
