For all the talk by congressional candidates last year of repealing Obamacare, sane observers knew that it was never going to happen in one full court press. From the beginning, this was a process which was going to have to be tackled piecemeal. While court challenges to the government mandate may eventually cut the legs out from under it entirely, other sections have been targeted for a legislative remedy and the first of those is now heading to the president’s desk.
After a months-long battle, the Senate voted Tuesday, 87 to 12, to repeal the 1099 tax-reporting requirement in Democrats healthcare reform bill.
The measure now goes to the president, who is expected to sign it, making it the first part of his partys signature reform bill to be scrapped.
The measure, initially included as a funding measure for the healthcare bill, does away with the requirement for companies to report to the IRS transactions valued at more than $600. While the provision has had few backers in either party, debate over its repeal had dragged on for months.
Robert Menendez (D-N.J.) introduced a last minute amendment which would have bogged down the repeal, but it didn’t even get the support of all the Democrats in the chamber.
Mitch McConnell was out praising this action as what he termed, “the first of many repeal votes.” Only time will tell if that’s true, but this was certainly a good place to start. The 1099 requirements introduced a huge paperwork burden on small to medium size businesses and would have resulted in driving health care costs up, precisely the opposite of the ostensible intentions of the legislation.
This is the first of many examples proving that Nancy Pelosi was right all along. We had to pass the bill to find out what was in it, apparently. And what we found was a series of provisions which make it more expensive for employers to do business, discouraging hiring and slowing the nation’s economic recovery. Here’s hoping that Mitch is correct.
What about the tax on home sales?
It’s a mistake to repeal any single part of Obamacare. The whole thing has to go. All else is appeasement designed to make the rest palatable.
It took 10 years to undue Mccain/finegold. This can be done also, but will take years and screw up medical coverage in the process. This is just the first shot to take it down...there will be more, but patience will be needed...
Repealing this provision is irrelevant. Regulating health care is not an enumerated power granted to Congress in Article 1 Section 8 of the Constitution. Therefore Obamacare on its face, regardless of the content, is Unconstitutional. The people are not bound to comply with an Unconstitutional act of Congress.
I’m pretty sure that only the dimmest of the Congressional dimwits ever actually believed that the 1099 provision would survive. The 1099 provision was merely a gimmick inserted in health care legislation for CBO scoring. For propaganda purposes, the Dems needed CBO to score the legislation as more-or-less deficit neutral.
The list, ping
Let me know if you would like to be on or off the ping list
Yes, the ever brilliant Barney Frank of the Ways and Means Committee wanted this to eventually start taking withholding taxes from 1099 Contractors up front. Shows you how much they know about income and taxes. Now everyone including the office supply store was a 1099 Contractor. Pretty spiffy huh?
One word for the repeal of the 1099 provision: STAGECRAFT!
Does the IRS still get its 16,000 new agents? New shotguns?
Was the 1099 provision included just so it could be removed in a painful protracted process that ultimately wearies everyone to repealing the whole bill in one swoop?
If you have been paying attention you know the answer to both questions is YES.
>>> “Its a mistake to repeal any single part of Obamacare. The whole thing has to go. All else is appeasement designed to make the rest palatable.”
Agreed. It lives as long as it’s only chipped at piecemeal.
And if it turns out to be Romney facing off against Obama, f-it. I’m voting 3rd party to avoid endorsing either one’s unConstitutional notions regarding health care.
What’s this? Good news?
Need some of that.
I was up until 1am following my state’s WI Supreme Court results.
FReepers, continue to pray for us WI conservatives. We need Justice Prosser to remain on the court, or all is lost for us for 10 years (it’s a 10 year court term for the commie, or for Prosser(God Willing).
You heard about this one?
Mackinac Center Received Bomb Threats and Death Threats Over FOIA Request

(Jean S, I thought the end of my comment, about Vicki’s Milwaukee show might be of interest.)
No I had not heard of that particular threat.
However it was a little tough keeping track of all the threats against repubs here in WI.
The one that gets the most attention is the public school indoctrinator who teaches young children, according to Rush today, she teaches kindergarteners. Before I heard it was elementary kids. She has still not been arrested, 3 weeks after very violent and specific threats to elected officials and their families.
The dems seem to have vote frauded their way to a 200 vote lead over Prosser.
Numerous stories of fraud poured in on talk radio today. Many blatant fraudsters, aided by the poll workers themselves. Worst stories were in Milwaukee. Vicki McKenna, show host, said she will put today’s show on pod cast and leave it there for a long time so all can hear the stories of fraud.
She is referring some of the callers to the Attourney General JB Van Hollen, they were such outrageously blatant fraudsters. One poll worker told a complaining man, to mind his own business, when the man told the poll worker that voters were going through and voting multiple times with differing names. “Mind your own business.” That same man was told by a black voter “White votes don’t count” or something to that effect.

The Vicki McKenna Show
One lady called in and said her poll worker told her to only fill in the ballot very lightly with pencil. So THEY could later fill it in for the real vote probably. A man said he was offered a photocopy ballot and told that the poll worker would fill in the real ballot for him. He refused of course.
She took calls for 2 hours. All voting problems and apparent fraud.
There were way more fraudulent votes than the 200 KloppenCommie is leading Prosser by. I bet there were several thousand fraud votes.
That was the main travesty of the ObamaCare crap. Civil servants who think they can just do as they please. Someone should shove that witch Pelosi's broom up her a$$.
