Everyone here seems to have forgotten a key ingredient to all of this lawmking, because without, the laws will fail, and if not in the courtrooms, then in the streets.. The founders were aware of this vital element, and wrote about it. A fellow by the name of John Locke gave it even more attention.
Yeah, that's right, at some point you're going to have to figure out if you have the consent of the governed. The founders had that consent with blasphemy laws, you would not find it today. The founders found that consensus with their population when it came to fornication. You won't find it today.
Laws do have to reflect the values of a certain portion of the population, or it goes horribly wrong. See entry at Prohibition. Prohibition not only failed, but created a criminal infrastructure that continued on after its repeal. Why? It never had a chance, way to many in the population were ready to ignore it.
Now if you think prohibition got ugly, you go ahead and outlaw fornication and see how well that works out for you. I' guarantee you on the outset that you won't have nearly enough funds to police it, and juries will spring up to bite you at every turn.
