One of our members has claimed it’s a HIPAA violation for the hospital to confirm Obama’s birth at the hospital. To publish this letter, they would have to have permission. If they do have permission, then they can now LEGALLY confirm if he was really born there or not. If he did NOT give permission to publish the letter, then this should result in a possible $250,000 fine and 10 years jail time (or something like that) if what the member said is actually true. Is that why they’re hiding the letter now?? It’s too late since it was published.

I wouldn’t be surprised, but it still wouldn’t mean that the hospital should be having a letter like that published when a couple of months earlier they said they could neither confirm nor deny that Obama was born there because of HIPAA regulations. It’s one more hole in the Obama nativity myth.

Well heck-If Hawaii is home ( to the dopehead ), then lots of vacations can be taken there-mostly on our dime. And the weather is just so fine there for lots and lots of golfing. And what a great place to retire. As opposed to Kenya or Indonesia, well, it just smacks of civilized tropical bliss.

It's not quite that simple (and I'm one of the co-authors of the HIPAA compliance manual for the Georgia Hospital Association).

First, let's hop to the end and get to the issue of penalties. Claims by an individual that his or her HIPAA rights have been violated must be brought by the individual. A state or federal agency can't simply bring those. Obama would have to go on record as bringing an action against the hospital for re-disclosing a letter than (a) he wrote to them to assist with a fund-raising campaign, and (b) had already been published in hospital fund-raising materials and the hospital's magazine, to which he apparently didn't complain at the time. Second, Obama's complaint goes to the Office of Civil Rights of the Department of Health and Human Services.

There are tiers of penalties. The $250,000 that you mention is only available if somebody intentionally provides protected health information with the intent to sell, transfer, or use the PHI for commercial advantage, personal gain, or malicious harm. That major fine is preserved for cases such as when somebody is stealing social security numbers.

Disclosing under a false pretense can get you up to $100K, but that's a maximum fine.

Simply knowingly disclosing starts with a $100 penalty. That's it. $100 dollars. In cases where you're a repeat violator, or you don't have any protections in place. or it's an egregious case, you technically COULD get up to $100,000. You simply don't see that happening.

In this case, where Obaama wrote the letter with the intent that it would be made public for fund raising, the hospital is not creating any additional harm to Obama, There are already copies all over the Internet. If they were penalized at all, it would be $100, although I doubt they would be penalized. And I've dealt with cases like this involving things much more sensitive than letters saying "hey guys, I was born there."

Queen's Hospital. That's the biggest problem. Queen's Hospital.

Until Obama wrote the letter to Kapi'olani Hospital in 2009, he and his relatives has always claimed that he was born at Queen's Hospital in Honolulu.

The AP, Wiki, Snopes, everyone has Queen's listed as his place of birth. Lookie here for scans of some earlier newspaper articles regarding Obama and Queen's. The miraculously changed it to Kapi'olani without a peep after Obama's letter, without asking why interviews with him from the time he was elected State Senator, and interviews with his family member, all indicated he was born at Queen's Hospital.

No, I think there's a chance that Kapi'olani may have done some homework and is stuck in a difficult spot. They feel a need to display the letter, but they're not going to promote it again because they have no record of Obama being born there. That's just a guess.

I am continually amazed at how many communists, nuts, and corrupt officials there are in Hawaii. I know that the Communist Party USA and its allies almost took over the Democrat Party in the late 40’s (Sen. Dan Inouye helped led the fight that prevented this), but the resurgence of the old marxist Left in politics - Abercrombie and Akaka - and the willingness of hospital officials, govt officials, and some in academia to cover up documents about Obama is a national scandal and should be investigated by Congress.


However Hawaii had a Republican Governor, a Republican Attorney General and a Republican administration during the time that Obama was running for the presidency and for the first two years of his term in office.
It was the administration of Governor Linda Lingle that did everything in their power to back Obama and support his birth in Hawaii.

This issue kept coming up so much in the campaign, and again I think it’s one of those issues that is simply a distraction from the more critical issues that are facing the country. And that’s just a fact. And yet people continue to call up and e-mail and want to make it an issue.
