This is such a tempest in a teapot. It's ridiculous. This is a case about two parties voluntarily entering into a binding arbitration agreement. This happens everyday in America. Binding arbitration, between individuals and even businesses will apply non-American law in the arbitration process. It's incredibly common in international business agreements, and it's enforced everyday in American courtrooms.

I promise you that if you looked at arbitration agreements in the diamond trade in NY, MANY of them will have provisions based solely on arcane Jewish law.

Things that some people worry about, especially given real problems in the world today, are just pathetic.

And if the two parties “voluntarily” enter “into a binding arbitration agreement” that says the loser gets his right hand chopped off, is that okay too?

They will have court precedent that Sharia trumps constitution.

Not too pathetic of a concern imo.

If I and the person with whom I am disputing something, decide to abide by the Law of Wicca, and we both agree to accept the decision of teh Holy Virgin of the Holy Oak Trtee, who is to tell us “NO”?

Ok, there is the possibility that LAZ ‘hits’ the virgin, and that may be an issue, but otherwise, people can agree to just about whatever they want.

I’m worried about allowed Sharia-based arbitration. Imagine a woman in a Muslim community under such arbitration, and she’s being screwed due to misogynistic Sharia implementation, and wants to go to the courts to get a fair deal as is the right of any American citizen. Sorry, she’s stuck with Sharia.

I’m with you. The court doc read pretty much like Paul’s instructions to the Corinthians regarding conflict resolution amongst Christians.
