Wisconsin Judge Blocks Union Law(GOP passed laws are treated differently by courts than Dem laws)

A Wisconsin judge Friday morning issued a temporary restraining order delaying the implementation of a law that will curtail collective bargaining for public-employee unions.

Judge Maryann Sumi said that a lawsuit filed by the Dane County District Attorney had enough merit to delay Secretary of State Doug LaFollette from publishing Gov. Scott Walker's budget-repair bill while she reviews the case. The law takes effect when it is published.

In his complaint, Dane County District Attorney Ismael Ozanne argued that the state's open-meeting laws were violated when Republican leaders moved the bill through committee last week.

Previously Another Suit Challenges Wisconsin Union Bill (3/16/11) Restrictions on Unions Signed Into Law (3/12/11) Sparing Police, Firefighters Makes Cost-Cutting Tough (3/11/11) Wisconsin Curbs Unions (3/11/11) .Journal Community ..Mr. Walker signed the bill into law on March 11, prompting tens of thousands of protesters to demonstrate in the state capitol and a slew of lawsuits aimed at stopping the law from going into effect.

Judge Sumi is scheduled to hear a separate case Friday brought by Dane County officials alleging that Republicans did not have the necessary quorum in place when they passed the bill.

Cullen Werwie, a spokesman for Mr. Walker, said, "This legislation is still working through the legal process. We are confident the provisions of the budget-repair bill will become law in the near future."

Andrew Welhouse, a spokesman for Republican Senate Majority Leader Scott Fitzgerald, declined to comment on the judge's ruling "because it's an ongoing legal matter."

Senate Democrats, who had fled the state last month to protest the bill, said the ruling puts Republicans in a difficult position.

“Judge Sumi is scheduled to hear a separate case Friday brought by Dane County officials alleging that Republicans did not have the necessary quorum in place when they passed the bill.”

So she's not done yet. It's time for the GOP to do it again but this time make sure the Rats are locked up for at least 24 hours.

Since one can file a direct appeal from the issuance of a TRO or Preliminary injunction this just gets the issue in front of the Court of Appeals that much quicker.

The Republicans should immediately move a vote to impeach this judge. It only takes a majority of Senators and Assemblymen to impeach. It does not require a quorom.

The influx of communists includes thousands of judges in America. This injunction is not valid but just a stopgap to prevent the law from taking effect. Why Walker does not expose this judge an a liberal activists will be beyond me but Walker will not. Walker should instruct that this law be read in and will be the law of WI. Time to take these rotten judges and kick them in the butt.

Do that and Wisconsin will be totally Democrat by next year.

Having lived in Wisconsin for 10 years before moving back to California, it’s a purple state. The GOP has been killed publicly the last month there with their actions. I support Walker entirely, went to school with him at Marquette University, but when you overreach it causes problems.

Impeaching this judge would be a HUGE overreach.

Rule 93 says the 24 hour notice does not apply to Special Sessions.

Anarchy.

Our government has failed.

The law of the land is now brute political power - take whatever you can grab.

Compare with $7500 gov kickback for the Volt - and ONLY the Volt - to make it even possibly close to marketable. Our tax money supporting government/union owned car company.

Governor should just close the government for a few days. Declare state of emergency - sue his own government for “clarification of operating rules”. Can’t move forward until this gets cleared up - etc.

100% WRONG.

“Sumi said her ruling would not prevent the Legislature from reconvening the committee with proper notice and passing the bill again.”

“Even if the Legislature is forced to come back and take up the bill again, at least one Senate Democrat will be there. Sen. Tim Cullen said he would not leave the state again.”

Question for Wisconsin legal eagles. Wouldn’t a county judges’ ruling only be valid in that county?

The law takes effect when it is published.

If the law isn't published and doesn't go into effect doesn't that mean that lay offs will still take effect. If they can't get another judge to enjoin the lay offs the spit will really hit the fan.

We no longer have constitutional rule of law, when one side prevails, AGAINST current law. And the Pres_ent IGNORES those same laws.

This is tyranny.

What a travesty and a joke.

As an Illinois resident, I want to thank America’s Dairyland for taking the Stupid State title away from us.

Sumi obviously valued the support of the unions and Dems more than the black mark of having an appeal against her.

Screw them all...Matistan is proving to indeed be 25 square miles surrounded by reality...
