I'm open to this beind defended. But we should not succumb to temptation just because we might agree with the outcome. There needs to be a truly Constitutional rational for this.
I’m not sure the legislation is a good idea either. This is something that needs to be done within the states.
At this point I also think we need to drive a wedge between public and private sector unions.

It is a federal law (the Wagner Act) that enables unions to organize and operate as they do. It is another federal law (Taft-Hartley) that enables states to opt out of the closed shop provision (right-to-work).
Rather than a national right-to-work law, a better solution would be to implement Taft-Hartley nationwide, then let individual states opt out.
Imagine the union trying to get a closed shop initiative thru the legislatures...
