Did Obama just move to save the health care law? (No because it's still unconstitutional)
cbs ^ | 2/28/2011 | Brian Montopoli

President Obama announced Monday morning that he supports a plan to allow states to essentially opt out of much of the health care law in 2014, so long as they come up with state-based plans that match the law in terms of extending coverage and benefits and don't add to the deficit.

The measure, if passed by Congress, would move the potential opt-out date up from 2017 to 2014 -- the same year that many of the key provisions go into effect, including the individual mandate, which has served as the basis for constitutional challenges to the law in court.

The president's announcement raised questions about whether the White House was trying to find a way around the legal challenges to the law by changing it to make them moot. Two district court judges have thus far found the law to be unconstitutional, while three have upheld it; the matter is likely headed to the Supreme Court.

IN PUBLIC: Obama offers states flexibility on health care law...

IN PRIVATE: Tells liberals move will allow states to enact even more expansive reform...

Drudge headlines

He rams through an unconstitutional health law grabbing 1/6 of the economy; then he offers to complicate the ultimate judgement of that law’s constitutionality by trying to trick the states into enacting their own versions. What a guy!

Obama has no authority to force the states to create anything because the Federal law is unconstitutional as ruled by the courts.
If he wants Liberal states to bail him out and create their own exchanges then they can do that by their own rules and we have continually said that it is a state issue as Massachusetts has already done.

No. It’s just another head-fake for more power over the states. Watch The Other Hand.

Listen to Mark Levin.

IOW: “It’s ok as long as you implement it in your state-laws”? WTF?

Federal Obamacare is finished by all practical purposes so Obama is trying to salvage it through the states.
The states should just ignore this and wait till the SCOTUS kills it.

He knows Obamacare is DOA.

He has NO POWER or AUTHORITY to make states create their own Obama plan as a substitute

His arrogance know no bounds

Actually, this probably makes it EVEN MORE unconstitutional, as each time he gives somebody a “waiver” or “special authority” or whatever you want to call it, he violates the Equal Protection clause.

The Democrats are now caught trying to cover a bill that was and is unconstitutional. Obama sounds like Quadafi. He is also delusional and thinks he can make up his own story. Until the administration takes this to the Supreme Court, the bill has no standing. It is as though it was never passed. The Democrats will keep talking like this bill is still valid, hoping that people will fall in line and continue to implement it. We are bordering on a real problem unless we get these Democrat anti-Constitutionalists out of there. Vote wise from now on. Listen hard to what they are saying. Obama spilled his feelings on the Constitution out during the campaign, but people didn’t pay attention.

I don’t understand!

How can Zer0 decide how he will just go ahead and change the provisions within the POS law that he signed, that no-body read, without Congress passing alterations to the law???

What, does he poll his un-elected, un-vetted, un-chosen czars to determine the future of our country?

We’re getting into feudal King territory here. It’s getting closer to impeachment time!

More Obama deception...make it ‘appear’ he’s negotiating, willing to ‘bend’ alittle. Get a few states to opt out, making it ‘appear’ that the unconstitutional death panels, are a.o.k.

They are not.

The President of the USA is offering to provide exemptions from a federal law -- admittedly noxious, but a federal law nonetheless.

On what constitutional grounds does the President offer exemptions from a federal law -- passed by the Congress and signed into law by his own hand?

This is just one more unconstitutional action by the man who swore "to uphold and defend the Constitution of the United States".
