Why the Supreme Court has been compelled to hold a new hearing on Obama’s eligibility.

Drudge has linked this story from World Net Daily that notes the odd decision by the Supreme Court to hold a new “conference” on Obama’s eligibility to hold the presidency.

Let’s research WHY the court could be compelled to do this.

It MUST have something to do with the fact that Obama has no birth certificate on file in the Hawaiian Hall of Records with the name “Barack Hussein Obama” on it — since his original Hawaiian birth certificate with that name was sealed in the 1970s when he was adopted in Indonesia by Lolo Soetoro, his stepfather. At the time of adoption, a child’s original birth certificate is sealed away and replaced in the Hall of Records by a new birth certificate that bears the adopted parents’ names and the child’s new name, if a new name is given.

This is what happened to Obama, when he was renamed “Soetobakh” by his mother and stepfather at the time of adoption.

I thought a President can not have ever held citizenship in another country.

And for a very good reason.....divided loyalties, which the yoyo in the White House is constantly demonstrating.

Although I could be wrong about that.

When has he ever demonstrated loyalty to this country?

Why aren’t the LSM talking heads contacting the libs over at Hillbuzz and getting them to comment on whether Obama is an American citizen or born in the country or a Christian???

They only ask people that they can terrify into answering the way they want. The HillBuzz folks are not in that group. And it gets to the question of Patriots and fellow travelers. These folks make no bones about it, they are as queer as a 3 dollar bill. They loved Hillary and when she was trashed by the Media and the Left, it opened eyes. Now they are aligned with the conservative forces fighting this battle against Obama and the Progressive left that has usurped the Democrat party.

Yet, they are Reagans proverbial 20% disagree with bunch who are friends and allies, but our interests are not identical.

As a group this organization and especially Kevin DuJan have been excoriated by their own community, and yet they bravely soldier on because they have a sense of what is right. This is something that I respect.

Some people have a big problem with that. Understanding that this isn't about quid-pro-quo but freedom. HillBuzz gets this and frankly by their works they show the other side of "Gay" contributions that have been almost exclusively going to the Democrats in the past.

These are not GOProud folks, gay rights activists, just allies. The conservative cause has to learn to distinguish between folks who would have us engage in identity politics, and the corruption of you scratch my back and I will scratch yours. And the smart politics of understanding who is a friend and the respect that each human is due as long as they are abiding the law and making a contribution to society.

Otherwise, learning to mind our own business. The question of Tolerance verses Acceptance. Just as we hate the sin but love the sinner, we celebrate the good and recognize the source regardless of the other issues. Yet we must defend life and morality and our children's future but in a calm and fact based way. This is not just possible, it is necessary.

That is easy.

A carefully constructed sound-bite designed for media consumption. And that did work as planned! The media ate it like pigs.

But it was carefully and specifically crafted to avoid making an actual claim against the actual constitutional language. This is another example of Hawaii officials being careful not to cross the line and actually declare Obama Article II eligible.

Neither Ms. Okubo or Fukino claim to PERSONALLY backup the fact the Obama was born in Hawaii. They reference ‘the records’ and use ‘the records’ as cover. I am sure ‘the records’ may say that.

Remember that Brian Schatz also did not provide written confirmation that Obama was Article II eligible in his OCON. That OCON is legally worthless since it did not meet the legal criteria. It was included in the documents released by the CEO Cronin but that document was not needed or used to put Obama on the ballot in Hawaii. It was the National Party (i.e. DNC’s) document that DID meet legal standards in Hawaii that allowed Obama to be on the ballot in his ‘home’ state.

Simply - those that would know the fact have shown behavior that indicate they are not willing to go to jail for Obama.

This is pure speculation on HillBuzz’s part. He told Race Bannon he was born in Kenya, years ago.

This is all about what happened after BHO was born, why is the question so muddy. As I posted at a point earler, the accepted explanation for why the record is as it is, is because the original birth record was created by a report made by his grandmother or grandfather to Hawaii. This generated a record of his birth and the announcements in the papers. It doesn't establish where he was born, and that is a matter of some controversy. But, the fact that these contemporaneous records exist, muddles the issue. I have a friend who's birth certificate was generated in much the same way, they were born in Germany, but got an American Birth Certificate to affirm US citizenship. This was a common practice in the past and not seen as anything particularly odd.

Another thread in this Post has links to Stanly Ann's Passport applications, and this shows she didn't give up her US Citizenship when abroad... so it is possible that she didn't allow BHO to do this either, thus wiping away the need for him to re-register his US Citizenship.

It doesn't show her 1965 passport application, or any prior if they existed and folks have not been able to secure the release of all of her passports actually issued which is a separate record.

But she needed to renew her passport by 1970 which is odd. Is it possible that her original passport was issued in 1960??? Who knows. Odd that a 1965 passport had to be renewed in five years though. Someone can chase this back.

Nevertheless, this article lets go the controversy of his birth place specifically and concentrates on the issue of why is the current record being withheld.

This research of theirs pointed out to many people the existence of BHO's Indonesian name which many of us have seen now for the first time, and yet it is on this passport application as a cross-out by Stanley Ann, when she was writing the application. It is safe to say from this, that at least these folks have looked at this issue as much as any around here, and their theory helps explain why folks are touching this so gingerly. It becomes an issue of framing. And this is what the left and MSM have been doing all along, framing the issue wrong to confuse people.

Ultimately, asserting the Natural Born requirement of the Founders and the reasoning behind it is the real battle regardless of BHO, instead he has become the case in point for this requirement and now the states must inforce this because the parties have shown that they won't. If any state makes it the law that a candidate must provide proof of citizenship in the form of a long-form original Birth Certificate, then a whole class of people will have standing to insist through the courts that this proof be given even if the state authorities do not. Ultimately this movement will be the effective path. And, all else on this issue is speculation. But, I find this bit of speculation particularly compelling.

Then there would be an Indonesian birth certificate, would there not?

It is pretty obvious that the adoption was handled in Hawaii. So, no there isn't an Indonesian birth certificate. Especially as he wasn't born there.

But that’s not what DuJan said. He said Soetoro had adopted Obama in Indonesia. Indonesian adoption means an Indonesian court under Indonesian law and an Indonesian birth certificate.

I don't know who the bio daddy is, and doubt Maury Povich will ever get to say who the daddy is...what I am pretty sure of: Old Barry used his “citizenship” as an Indonesian to get free stuff or a leg up. Honestly...he has had those college records scrubbed so clean it stinks. I'm guessing he got a scholarship or grant under Indonesian citizenship.

Makes me sick this fraud has gotten so out of control and is in control of our govt.

If a portion of the country be taken and held by conquest in war, the conqueror acquires the rights of the conquered as to its dominion and government, and children born in the armies of a State, while [p665] abroad and occupying a foreign country, are deemed to be born in the allegiance of the sovereign to whom the army belongs. It is equally the doctrine of the English common law that, during such hostile occupation of a territory, and the parents be adhering to the enemy as subjects de facto, their children, born under such a temporary dominion, are not born under the ligeance of the conquered.

2 Kent Com. (6th ed.) 39, 42. And he elsewhere says:

And if, at common law, all human beings born within the ligeance of the King, and under the King’s obedience, were natural-born subjects, and not aliens, I do not perceive why this doctrine does not apply to these United States, in all cases in which there is no express constitutional or statute declaration to the contrary. . . . Subject and citizen are, in a degree, convertible terms as applied to natives, and though the term citizen seems to be appropriate to republican freemen, yet we are, equally with the inhabitants of all other countries, subjects, for we are equally bound by allegiance and subjection to the government and law of the land.

I’m wondering if the Obama daughters know of the true birthplace. If he was born in Kenya, you know they have been told that while growing up and before he ever decided to run for president. It was probably spoken about freely in their home. Who doesn’t talk to their kids about where they were born and their childhood especially if born in an exotic locale like Kenya.

I think that it was the statement of the Republican Governor of Hawaii, Dr. Fukino’s boss, that really made the difference.

Governor Lingle said: “You know, during the campaign of 2008, I was actually in the mainland campaigning for Sen. McCain. This issue kept coming up so much in the campaign, and again I think it’s one of those issues that is simply a distraction from the more critical issues that are facing the country. And so I had my health director, who is a physician by background, go personally view the birth certificate in the birth records of the Department of Health, and we issued a news release at that time saying that the president was, in fact, born at Kapi’olani Hospital in Honolulu, Hawaii. And that’s just a fact. And yet people continue to call up and e-mail and want to make it an issue. And I think it’s, again, a horrible distraction for the country by those people who continue this. ... It’s been established. He was born here.”

It was the Governor’s statement that has prompted Speaker of the House John Boehner to say: “The state of Hawaii says that the President was born there. That’s good enough for me.” And for the House Majority Leader, Congressman Eric Cantor to say on Meet the Press: I don’t think it’s[the Obama eligiblity issue] an issue that we need to address at all. It is not an issue that even needs to be on the policy-making table right now whatsoever.”

Is this picky - no! It makes a difference.

There is absolutely no difference. A Natural-Born Citizen is the same as a natural-born Citizen is the same as a Natural Born citizen is the same as a Natural Born Citizen.

The Supreme Court has made no distinction in any cases to which it has referred to any interpretation. Neither has Congress. It also does not fall in line with John Jay's letter to George Washington immediately before the Convention introduced this requirement.

As I continue to ask here, what is the intent of this requirement? Why did the framers insist it be present?

Obama’s grandmother died around the time of the 2008 election. His mother died in 1995.

At least that what we were told. Where are grandmother’s friends that knew little Barry. She supposedly lived in an apt—seems like you would know alot of neighbors. The whole situation surrounding the grandmothers death is very strange. Not one person (that I know of) has ever talked about her or BO or knowing them. Did she really exist?
