"A week from Tuesday, when the Supreme Court returns from its midwinter break and hears arguments in two criminal cases, it will have been five years since Justice Clarence Thomas has spoken during a court argument."

"If he is true to form, Justice Thomas will spend the arguments as he always does: leaning back in his chair, staring at the ceiling, rubbing his eyes, whispering to Justice Stephen G. Breyer, consulting papers and looking a little irritated and a little bored. He will ask no questions."

Ruth Bader Ginsburg has dozed off during oral arguments. This has been documented, but ignored by the liberals in the MSM. It’s hard to think that she was paying attention if she was asleep. Yet this liberal hit piece seeks to accuse Clarence Thomas of not paying attention and doing his job if he’s not asking the questions during oral arguments.

So, a justice who is attentive but asks no questions is bad, but a justice who falls asleep is okay.

I think in truth, a liberal justice who falls asleep will be given a pass, while a conservative justice will be nailed for any transgression, real or imagined.

Would Clarence Thomas have been called out if he had fallen asleep? I think we all know the answer to that one.

I’m surprised to hear you say this. Clarence Thomas has had a long record of voting the right way, the conservative way, the constitutional way, in case after case.

He doesn’t join in the small talk because most of it is bogus. At least three of the justices are idiots, who probably have never even read the Constitution, or at least hold it in scorn. What’s the gain in making small talk and asking fake questions with idiots. Thomas knows how he intends to vote.

If you want to complain about SC justices, how about the fools/leftist/perverts Kagan and Sotomayor? Why no word about them? Only criticizing Thomas?

LOL Ginsberg and the wise latina are both aff. action justices. Cause they are female and minority. I will lay odds that you have never read any of Thomas's rulings as such from the court...

I watched a lecture to school kids in the inner city that Thomas did, and he explained all the going on's of the court and why he doesn't ask questions during oral argument...I have never said this to any freeper before, but you must be a liberal troll and a bigot to write what you do about Thomas.

Especially your affimative action remark without looking at the other justices and why they were put in place....

That’s a cheap shot. Questions by Justices are mostly sallies and oneupsmanship against colleagues. This makes for a good show at oral argument but rarely helps resolve cases. And anyone who thinks Justice Thomas is a lightweight ought to read his opinions. They are clear, well-reasoned, and manifest a coherent originalist philosophy.

In the end all appointments are political appointments, and all elected are elected by a political process.

A man becomes a judge because politics doesn’t disagree with him. Judge Thomas’ selection for the court was indeed a political choice and a major reason for it was that he was then and continues to be, a negro. It is something he cannot change of his being.

Political winds blow this way awhile and then that way awhile. We are lucky that he was appointed, and we all benefit today by his HEROIC sufferance of the awful hearing process he went through.

IMO. he is the Judge on that court who reasons most close to that abstract and golden ideal that the Founders had for our nation.

Do you really think that he would have got the job were he not black? Was he really one of the great legal minds? Of course not. The man votes well but he was nowhere near the most qualified person for the job and would not have got it were he not a negro.

Justice Thomas has more class than 90% of the dopes in DC.

Thomas spoke up once during a cross-burning case before the court. Said exactly what a burning cross represented to him. Very pointed commentary that scorched the free speech argument that the attorneys were trying to make.
