Any one who approved the electoral college certificates of assertainment in the house of representatives will have no deniability. This issues was right up front in 2008-09 when the ec was meeting and when the house counted the votes. Additionally, the electors in the states are criminally implicated as well. Electors can vote for whoever they choose, and are not bound by the will of voters. In my opinion, voting for an ineligible person on the presidential electoral college ballot is a crime. There is a reason why the ec was set up for electors to vote and not just have a numerical value awarded for winning each state. The electors were supposed to be the republic’s line of defense against unlawful candidates.
