Obama is the one who chose Biden. If Obama is proved not legitimate, then Biden should be out also, making it fall to speaker of the House, John Boehner. That would be the best outcome we could hope for.

Joseph Robinette Biden, born in Scranton, Pennsylvania to two US citizens, having attained the age of 35 years and resident in the State of Delaware for fourteen years prior to December, 2008 was chosen by 365 Electors for Vice-President of the United States, themselves elected by the citizens of the several states.

Joseph Biden is the perfectly legally qualified, elected, and chosen Vice President of the United States. His status has ZERO to do with Barack "Obama", and, should the office of President happen to become vacant, Biden would occupy it by right until January 20, 2013.

This is why I’m actually glad this issue got dragged out until now, as I surely didn’t want to see Nancy Pelosi installed as President: I think reasonable people can disagree who would be worse as president for the country: Obama or Pelosi. Now the chain of succession is quite different, provision much more impetus for Republicans to hold hearings/subpoena Hawaii officials and really get to the bottom of this. Boehner’s passive attitude about the situation is a puzzle to me. I realize he doesn’t want to create the kind of backlash that accompanied Clinton’s impeachment, but it’s hard to see the downside of issue a subpoena to get to the bottom of this mess. If it turns out Obama can prove his bona fides, Boehner/Republicans can get credit for clearing the air. But if it turned out people lied/covered up to protect Obama, I doubt the average American is going to view that as “just” a sex scandal. Most Americans will/ought to be deeply disturbed if Obama literally tried to end-run a constitutional requirement. In light of all the known lies Obama told about Obamacare, he does not have a reservoir of good will to protect him from the outrage likely to be spawned by an expose etc.
