The lawsuit was adjudicated two years ago. Roger Barnett, a rancher who had detained and held for border patrol pickup over 12,000 illegals trespassing over his property for the prior 10 year period, was the defendant. He’s a retired deputy sheriff and business man. His wife was also named as a defendant. Barnett testified before congress about border problems caused by illegals some 10 years before the suit was filed. Barnett and his family members have had guns pointed at them, their house broken into, vehicles stolen, equipment stolen and vandalized, literally tons of trash and excrement left for him to clean up, livestock stolen, killed and eaten, livestock poisoned, and generally had their lives made a living misery by these people.
MALDEF, the lawyer wing of the La Raza/LULAC/Mecha organizations, sued on behalf of 16 “victims” they dredged up who Barnett caught on his property and detained for the border patrol. The suit was based on a claim of civil rights violation. Judge Roll certified the case which allowed it to move forward. That meant that Barnett had to mount an expensive defense.
I’m surprised it took MALDEF 10 years to get even with barnett for his testimoney before congress.
Barnett eventually mostly prevailed, but it was costly and stressful, to say the least.
If the locals weren’t too fond of Roll for putting a solid, law-abiding American through such a terrible experience, you reap what you sow. AZ has the Castle Doctrine, something the judge evidently forgot. The case should have been summarily dismissed.
