First, it's not clear the police had a warrant with them when they kicked in the door to this guy's house. I quoted the article up in my first post.

Second, the constitution doesn't contain any provisions for a "no knock" warrant. It is unreasonable to kick someone's door in to serve a lawful (and constitutionally acceptable) warrant.

Any responsible citizen, when someone kicks in their door unannounced, is justified in responding with deadly force to defend their home. Period. The "cops" in this case were acting as criminals. They were breaking into someone's house in the dead of night. No piece of paper fixes that.

If instead of a golf club, this guy had had a gun and shot one of the cops, would he have been justified?

A warrant is permission from a judge to search a place for specific items or persons. It's not a license to kick in a door and invade someone's home. Yelling "Police" in the process doesn't fix that problem. Criminals invading peoples homes illegally also have been known to yell "Police, we have a warrant, get on the floor" as they break in to rob and pillage a home and rape and kill the people who live there.

Serving a warrant means presenting it to the home owner (or whoever answers the door) prior to entering the home.

People are so quick to rationalize their rights away under the guise that somehow it will help LE catch the bad guys.

We spilled a lot of blood and exercised huge risk to win our freedom and establish a Constitution that is brilliant and people need to better understand their contract with the government and we need to stand up and enforce our rights.

The people could have surrounded the front and doors and had people watching the windows, pounded on the door announced police with warrant and waited for the front-door to be open.

This reminds me of the insane raid on the whole milk producer in Oregon...the police barged their way in while customers were there brandishing assault rifles, etc...

This police state action is just completely out of line.
