Actually the agents are out and back in the states. The Italians tried and convicted them in absentia, which means that they will not be able to do their jobs overseas again (without being under threat of arrest and extradition) until this ridiculous case is squashed once and for all.
They were never imprisoned at all.

I believe they don’t have to be released, as they haven’t even been extradited and are not incarcerated in the first place. This verdict was in absentia to best of my knowledge.
I wouldn’t expect them to actually be in custody. The article indicates that they are not.
