Rep. Bachmann: Tax Bill Violates Article 1, Section 7 of U.S. Constitution

Rep. Michele Bachmann (R-Minn.) told CNSNews.com that the tax bill passed by the Senate on Wednesday violates the U.S. Constitution.

“Article 1, section 7 says that all revenue bills originate in the House and that is our province and, of course, this originated in the Senate,” she told CNSNews.com in an interview Wednesday on Capitol Hill.

The House of Representatives is expected to vote on the tax deal passed by the Senate on Thursday or Friday. The bill was the result of a deal cut between President Barack Obama and Republican congressional leaders.

Article 1, Section 7 of the Constitution states: “All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.”

In a video taped interview, Bachmann told CNSNews.com: “It’s a perfect example of what’s wrong in Washington, which is members of Congress not listening or reflecting [on] the Constitution or the role of the people. That’s why in January I’m starting new classes and seminars on the Constitution for members of Congress.”

I like her, she’s smart, but she’s not ready. I hear her a lot on Mark Levin and her woe-is-me attitude is not the kind of attitude you follow into battle.

Because the RINO leaders don't want her there since she believes in following the Constitution, just like the don't like DeMint or want him doing what he's doing.

I’d like to see Representative Bachmann raise a point of order on the motion to adopt, that the motion is out of order because it is unconstitutional. When Pelosi rules that the motion is in order, challenge the ruling and make the members vote to expose whether they support the Constitution.

The enumerated powers can be found at Article 1, Section 8.

note: Modern definition states that either the commerce clause or the general welfare clause, or both, show that the framers knew that they were wasting ink when penning these innocuous, almost turret-like utterances.

This would appear to make Article 1 Section 7 irrelevant by association.

Yes she is but what does that matter. Even though this tax bill is considered unconstitutional, it will most likely pass and maybe 5 or 6 years down the road the Supremes will decide 'Oh well'...

It's the same as the omnibus bill that funds Obamacare that was just declared unconstitutional by a federal judge. Oh well!!!

Bottom line is that these progressive liberals are totally out of control and don't give a damn what the American people want.

This bill funds Obamacare with over $1 billion to help implement it and counter any defunding effort from the new congress.

It is like the original bank bailout bill under Bush. The Senate got around this constitutional requirment by taking another spending bill and passing an ammendment that gutted the bill, deleting virtually the entire substance of the bill and then added the TARP stuff. Then it went to conference to coordinate the House and Senate versions, even though they were two entirely different bills.
