Congress deals death blow to Guantanamo closure

This year's omnibus spending bill refuses to close the prison at Guantanamo Bay and would block the transfer of any suspected terrorist detainees to the United States in what appears to be the final blow for President Obama's campaign pledge to shutter the facility.

The massive spending bill Democrats released early Wednesday morning would prohibit the Obama administration from spending any money either to transfer detainees to the United States or to buy a replacement prison in the United States, as Mr. Obama had planned.

Prohibiting spending effectively stops the administration from acting over the next year, and with Republicans about to take control of the House in January, his chances are virtually zero that Congress will relent any time before the president stands for re-election in 2012.

The bill, which will be voted on over the next week or so, explicitly prohibits the transfer of Khalid Sheikh Mohammed, the alleged mastermind of the Sept. 11 terrorist attacks.

"None of the funds provided to the Department of Justice in this or any prior Act shall be available for the acquisition of any facility that is to be used wholly or in part for the incarceration or detention of any individual detained at Naval Station, Guantanamo Bay, Cuba, as of June 24, 2009," the bill says.

Obama signs order to close Guantanamo Bay facility
January 22, 2009

Promising to return America to the “moral high ground” in the war on terrorism, President Obama issued three executive orders Thursday to demonstrate a clean break from the Bush administration, including one requiring that the Guantanamo Bay detention facility be closed within a year.

During a signing ceremony at the White House, Obama reaffirmed his inauguration pledge that the United States does not have “to continue with a false choice between our safety and our ideals.”

The president said he was issuing the order to close the facility in order to “restore the standards of due process and the core constitutional values that have made this country great even in the midst of war, even in dealing with terrorism.”

This bill should be stopped dead in its tracks and not because of the Gitmo language. The RATs are trying to lock in a years worth of spending and that damned unlimited transfer authority language is probably in there. This is an attempt to hamstring the new Congress for the first year of their existence, relying on a slim Senate majority to checkmate any attempt at correcting legislation. The Pelosi / Reid Congress is finished, don’t let them make this parting shot.

The appropriate Senate stance is “the people have spoken and it is an affront to ‘the consent of the governed’ for this Congress to put forth a full year’s worth of spending in a lame duck session. We have a continuing resolution to keep the government operating until the new Congress is seated. Only then should we take up a massive spending bill such as the one trying to be crammed through now.” Then filibuster the heck out of this omnibus spending bill.
