Most of my friends and business buddies lost nearly everything in 2001 - 2002. High flying jackasses who were into buying the next hot IPO got wiped out. I know some very astute people who were investing in quality for many years. Some (or most) have lost over 60% of their holdings in the past ten years.

Please bookmark this thread , in a few months as this all unfolds in the popular press you will understand that the banks own nothing ,, they never advanced money for purchasing or refinancing any home ,, it was all investors money and the banks have no loss at all , they were just a conduit (or to use the legal bad guy word “straw man purchaser”). Chunga85 , Kartographer and I among others want the RULE OF LAW to prevail... that will be VERY bad for the banks but will save the monetary system and ourselves from this continued depression.

In the usual exchange, I pay my mortgage and when I satisfy my Note, I get the security instrument satisfied. You can grasp that concept, right?
Now, suppose I pay my payment to BoC and they accept my payments, but when I pay my last one, they say I satisfied the Note, but the investor who holds the original says, “No, we never got consideration for it.”
They actually have a right to enforce, not the BoC. (Bunch of Crooks). I would have to sue BoC to recoup what I owe the investor to pay my legally enforcable Note, since it’s my signature. Do you understand how that would work?

If they fail, I get the house - it’s fair. UCC GS 3-309(a)(3b) states an order may not be entered in the plaintiff’s behalf if the borrower cannot be protected from another person claiming to enforce the instrument.

The homeowner must still repay the loan. His house wasn’t a gift from Santa. A bank gave him a check and he bought a house. Pay your bills or move out!
