Salt Lake City, Utah (CNN) -- A federal appeals court halted the trial of a man accused in the 2002 kidnapping of Utah teenager Elizabeth Smart just as it got under way Thursday in order to review the defense's request to move the trial outside the state.

EIGHT YEARS LATER. Does anyone see anything wrong with this. We need to get rid of some attorneys and go back to a “Swift and speedy trial”.

It’s disgusting!!!

The poor girl suffered hell but this lunatic gets treated like a victim! It’s more than just sickening.

Why is is so important to have an trial in an unbiased area and have such an unfair government for these appeals courts?

Colorado decided he was too nuts to stand trial so they chucked him in the loony bin in 2005. In 2008, the feds decided they'd prosecute him. Since then, they've been having hearings to determine his competency and they've convicted his wife/accomplice, who will testify against him at this trial.

The defense is hoping it gets moved to a more liberal state, where a jury will be more willing to consider an insanity defense. The guy’s trying to get a sentence in a mental hospital instead of in jail, where he belongs.

Just a side note - the judge is also the original trial judge from the SCO vs Novel trial that is documented on www.groklaw.net. He had to stop the trial while the defendant goes to a higher court an seeks moving the trial. It sucks! The Judge is a fair guy.

This “kidnapping” trial will never occur. On DAY 1 it was obvious that she willingly ran away. When they found her, she admitted it. These freaks are guilty of a lot of nasty stuff. But, they never broke in and kidnapped her. No one, least of all her creepy father, want that to become official.

Well, if push came to shove, we Utahns were willing to send Mitchell to either Florida or Texas for a change of venue. They’d take care of him.

BTW, the trial testimony is on. Lois Smart has finished, Mary Katherine is still testifying.

Actually, in this case, I believe in an eye for an eye. Either chain Mitchell to a tree in the Utah mountains and force him to do the things that he made Elizabeth do, or put him in prison where he can be Bubba’s friend.

Madam, I appreciate your humanity but, everyday he is alive he is well.... Still alive and all life wishes to live even as a beaten dog or an objectified sex toy.

I do not wish to give him the one joy of waking up everyday with any possibility of hope nor the pleasure of breathing oxygen.

He is simply a sociopath cancer and must be excised from the body of life.

He should never know pleasure ever again and we as humans should never be bothered with his care or live in fear of him.
