Prestigious law firm sues burger joint over smell
Washington Examiner ^ | October 14, 2010 | EMILY BABAY

It's a classic David and Goliath story: A white-shoe law firm staffed with hundreds of D.C.'s most-powerful lawyers has moved to shutter a hamburger eatery on the grounds that the lawyers didn't like the aroma of cooking meat wafting into their offices. So far, Goliath is winning.

With AC and heat why are their windows open? Can I sue my neighbor whose trash can sits to close to my backdoor and sells awful and drays flies in the summer because they eat a strictly oriental diet? They even put their trash can on our part of the sidewalk on trash day, and it has ended up in my flower bed down by the curb and damaged the azalea there.

I don’t think they have the right to shut ‘em down but its hard to argue about the smell. To my nose, those burgers smell like an armpit that needs a bath.

Prestigious law firm sues burger joint over smell...

If I were the burger joint owner I would counter-sue... can’t imagine the smell coming from an alleged “prestigious law firm” filled with D.C. attorneys would be helpful for business.

I don’t like the smell of lies and greed that wafts out of attorneys’ offices.

How bout this, “Law firm joint sues prestigious burger restaurant?” I don’t know which is worse, attorneys or news people.

Note, the burger joint portends to produce a product for profit. While the law firm produces paper to destroy capitalism. Perhaps the Burger Joint should sue the Law Firm under Kelo and eminent domain as they would do better with a larger building and a better location.

“The prestigious firm, whose alumni include corporate leaders, judges and government officials, argued that Rogue States’ second-floor exhaust vent expels fumes into Steptoe’s air-intake system.”

Some of you should read the entire article before rushing to judgment.

This case is interesting, & the burger joint is not without fault, IMO.

The burger joint moves in a few months ago, & its exhaust vents are near the air intakes for the lawyers’ offices. Naturally, the exhaust is more than just the smell of burgers & fries.

Burnt smells, cleaning fluid smells, & Garbage smells are all present, & I know this for sure, because my home is < 100 feet from the back of a restaurant/bar & I have worked in both in my youth. Sometimes it can be a nuisance. If I had an air intake right next to their exhaust, I would be very unhappy. The smell of fresh air is quite pleasant.

Given that the lawyers & their air intakes were there first, it seems reasonable that a new neighbor business should respect those intakes when implementing their unpleasant exhaust. But at the same time, the lawyers might want to relocate their air intakes to a better location that avoids all street level odors & air.

I suggest both parties get together & call Mike Holmes. He will Make it Right!

I’m still on my first cup of coffee, and working with only one eye...new glasses post cataract surgery won’t be in for 7-10 days...they had to order the lenses, so I’m functioning with vision in 1 eye on a 3 year old out dated RX pair, that 1 lens has been removed from. No glasses and my world is a blur. LOL

I see your point, but with all of the clout of the layers, judges and the other important people and with all of their money, why can,t they just change their vent or just talk to the restaurant owners and come to an agreement? seems simple enough.

With people like that governing the country no wonder we are going down hill.

I have some solutions.
No1
Don,t let any one go to college unless they are willing to work digging ditch or etc to pay their way.

No2
Don,t let any one go to work for the government until they have worked at least 10 years for the private sector.

No 3
Don,t let any one run for public office unless they have run a private business for 10 years.

I’m not quite that blind, I am functioning with 1 lens in my eyeglasses...which is a out of date RX by 3 years. I zoom the screen up as much as possible.

Those are very sane solutions to some of the idiocy we see today. I would add one more however and it may be the most sane. Never let a lawyer hold public office.

This may be a great precedent.
