I suspect you're right. So what? The issue at the Lakin trial has nothing to do with what LTC Lakin believes about the President's eligibility -- even if he's right.
No one's doubting Lakin's right to have an opinion. But nothing concerning presidential eligibility has any bearing on the legality of his orders. The judge said that, and now his own lawyer is saying the same thing.
And of course many others said the same thing early in the game, long before he chose to commit his crimes. He was foolish to pursue a course that was clearly in violation of the law, and he will pay the price for his criminality.

The obvious crime is the person who is occupying the Oval Office, and just because people in this nations do not want to face the reality will make it true. Sometimes people make stands on principle; they rise above their petty wants that the leftists can only see beyond their noses.
