If that guy had a tracker on his vehicle, there was a VERY good reason for it, either because of his activities or associations. There are so many people that need to be spied on in our “open” society, that law enforcement has to prioritize.

What we have to remember is the 4th Amendment protects against UNREASONABLE intrusions by the government.

A government law enforcement officer had to present this idea to both prosecutor and judge who weighed it’s level of intrusiveness before allowing it, even without a warrant.

The kid’s a Muslim; his daddy is a Muslim with ties to the Middle East; why am I having trouble feeling compassion for him?

AS long as you never speak out against the a- holes in government and you act meek and gentile like a lamb and then if you just do what your wife and the government tells you
and never argue, you will maybe not have to worry about it, but if you believe in living in a free country, don,t count on not being watched.

I don’t think the Feds would have put it there if they didn’t have probable cause but then that’s just me.

Though a law abiding citizen, I fear the cops and our gub mint much more than I fear the criminals at this point.

My thoughts exactly, at the same time i do fear criminals because they are taking over the government.

And the Patriot act came from Bush
as did Tarp and the GM bailouts.
learn to accept that the Government is the problem it is one of our beliefs here.

This is a bit more intrusive than following a suspect. What if the person drives onto their private property? I suppose the GPS device would continue transmitting. Police wouldn’t be able to go onto private property without a warrant, right?

Technology has already given the police the ability to follow a suspect onto private property, it is called aircrafts. A plane or a helicopter can (and do) fly over private property all the time. I believe law enforcement has been using aircrafts for many years. So your comparison is moot.

Further, law enforcement can (and have) found viewing vantage points overlooking private property to observe what was going on.

Since a GPS tracking device so far only details the location of itself at any given time, I do not think the courts will rule it unconsitutional. Now if they were to add a voice recorder, that would require a warrant.

Gestapo tactics, in the disguise of National Security, is not only unconstitutional, it is violation of moral values.

You got that right, and once one of these laws is made then it is turned over to the law enforcement and they do what they want with it, why would any one want to be in the f.b.i or some other big law enforcement agency unless it was to walk over other people, do these people really believe in a free country? i don,t think so.

“It’s not a matter of if, but when, the Tea Partiers are tracked in the same manner.”

When that day arrives (if not already here) I suggest a mass mailing of these devices to Canada and Mexico ...track that!

-- First,I've read about police using these tracking devices without a warrant before and have read that the courts (don't know which ones) have said it's OK. --

Mixed bag, at the present. A couple state courts have said a warrant is required (Mass, NY), as has the DC Circuit (US v. Jones, decided August 2010)

However, if a (any) purpose of the surveillance is to gather "foreign intelligence information." Such gathering is purely an executive function.

I believe the FBI's formal position on the issue is that no warrant is required, period. It intends to litigate the issue to a conclusion.

Difficult, difficult situation.

My knee jerk reaction is to scream out for individual American citizens against unwarranted government intrusion.

I believe your knee jerk reaction is what makes sense.

Benjamin Franklin,
Those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety.

That truly is GWB’S fault. Any thing you name the patriot act is sure to be abused. Compasionate conservatives and neocons cheered the loss of our liberty. Unlimitedpolice power.

I don't understand this? The whole precept of Islam is to over rule the world by murdering infidels. Do you really think this is an "abuse" of the PA? Nobody cheers the loss of liberty, but you sure as shinola can't have liberty after death now can you?

Muslims are the ones going around killing innocents in the name of their cult religion, therefore everyone of them should be tracked! Not only does their scripture condone murder, they have proven they are willing to do it on our own soil.

Get your head out of your ass, WE ARE AT WAR!

This seems like a clear cut invasion of property rights

I was wondering why he ran out and got a lawyer.
I was thinking if I was bugged - I would shrug it off - thinking they had the wrong guy.
I see my thinking might have been wrong...go get a lawyer - I see how that would help.

how would it help me, again?

And as for the moslem knuckledragger,I think that every damn moslem in this country should have a GPS device tracking them 24/7/365.

I don,t like the Muslim religion, but then i don,t like any religion, but because i believe in God and his son, i believe in doing to others as i would have them do to me.

If it can happen to a Muslim it can happen to a christian, or any one else, in fact Christians suffered at the hands of the so called law abiding citizens of Rome and many other times since Even from the law that was prompted by the so called Christian church itself.

If you take a good look at history its easy to see why we have the constitution and why its so important to hold the power of the government to a minimum.

P.S
why are there so many Muslims over here to begin with? would it have something to do with our people in government? why let them come here if they feel that they must put tracking devices on them,? is it for an excuse to make this a police state?
