I'm not. If there is a reason to suspect him of something, you can get a warrant. From reading the article, it doesn't sound like he is guilty of anything other than fitting a profile. The problem with condoning warrentless surveillance when it is against a "possible Moslem terrorist", is that once the precedent is established, its much easier to justify that surveillance against a "possible right-wing terrorist", for example.
