Article 3 of the Constitution is, imo, a fatal flaw.

What part of NINE doesnt he understand? The Constitution says nothing about the number of Justices on the Supreme Court.

Judges should never have been given life appointments to begin with, if the constitution is a “living” document like the liberals claim, then since the average life expectancy was probably 40 back then... all judges should be forced to retire at 40 or whatever the expected life expectancy was back in the 1700’s

Senate Judiciary Chairman Patrick Leahy, Vermont Democrat, has proposed a bill that would allow for retired Supreme Court Justices to sit on the court by designation in cases where the active justice has recused. I think Bill Clinton should sit in as POTUS while Barry is golfing.

Just make an even number recuse. As long as an odd number remains to hear the case.
Wait until 0bama realizes there is no Constitutional limit on the number of justices the court can have(as long as it's odd). He'll just appoint 2 more justices to the court, making 11 then the left will win every case 6-5.

Reading through Article III makes me wonder... where does the concept of serves for life come from? It comes from the lack of a specified term, since the President and both chambers of Congress have terms associated with them.
Article 3 says only that they "shall hold their Offices during good Behavior." That seems pretty indefinite to me.

Vermont has graced America with three Vermont village idiots: Leahy, Sanders and Dean.
I would give my eye teeth to see all three of them relegated to infamy and the scrap heap of history.

So long as said Justice is in an urn, I’m OK with them sitting in on the Court.

Same should go for both houses of Congress and the White House.

Oh, when they (Kagan) recuse themselves. Yeah, that happens. Thanks paltz.
