To Whom It May Concern:
It has come to my attention that you have made numerous unauthorized references of the term Tea Party Candidate in association with your campaign. You are hereby put on notice to cease and desist from using the phrase Tea Party Candidate in association with your campaign, campaign material and media advertisement surrounding your campaign.
I am in the process of securing the rights and have applied for the trademark usage of the term Tea Party Candidate to be used in association with my campaign for United State Senate at the United States Patent and Trademark Office ("USPTO°).
I demand that you immediately cease the use and distribution of the term Tea Party Candidate in all of your campaign material and media advertisement and that you further desist from this or any other infringement of my rights as the only authorized Tea Party Candidate of Nevada.
We would like to resolve this matter amicably as soon as possible. Therefore within one week to the date of this letter, please confirm your willingness to comply with the demands contained herein and please confirm within one week of the date of this letter references to Tea Party Candidate will be removed in association with your campaign.
Please do not force us to take further legal action in this matter.

What about “Tea Party Senatorial Candidate” or “Nevada’s Tea Party Candidate”. Trademarks are national, so what about all the other “Tea Party” candidates?

Sounds to me like this cement contractor is his own lawyer.
I dont think he will have much luck with the trademark office trying to claim that the words “tea party candidate” are so uniquely associated with him that he deserves a trademark.

Scott Ashjian, today sent a cease and desist letter to Sharron Angle (with her first name spelled wrong) and also to CNN and FOX to get the GOP nominee to stop calling herself a Tea Party candidate. He actually claims -- wait for it -- that he is trademarking the name for his campaign.
