He gets the principle of negative rights, as applicable to Koran burning, correctly on this essay.

It’s a stupid publicity move, and even impolitic as it tends to harden “moderate Muslims” which America would rather have as allies than foes, but the government is duty bound to not ban it.

Would it were that Breyer always stuck to negative rights, i.e. principles of how the gummit must leave the people alone.

Yeah, I’m thinking Breyer engaged his tongue before his brain was in gear on that one. A right that only exists if a feller with a bomb doesn’t object isn’t a right at all. Good to see the clarification. A retirement notice would be even better.
