Justice Stephen Breyer: Koran Burning May Not Be Protected Under the First Amendment

Last week we saw a Florida Pastor – with 30 members in his church – threaten to burn Korans which lead to riots and killings in Afghanistan. We also saw Democrats and Republicans alike assume that Pastor Jones had a Constitutional right to burn those Korans. But Supreme Court Justice Stephen Breyer told me on “GMA” that he’s not prepared to conclude that — in the internet age — the First Amendment condones Koran burning.

“Holmes said it doesn’t mean you can shout ‘fire’ in a crowded theater,” Breyer told me. “Well, what is it? Why? Because people will be trampled to death. And what is the crowded theater today? What is the being trampled to death?”

So what happens when muslims object to us saying Christ is the only path tp God? Is that hate speech even though it is what God says? Do we have to become what everyone agrees with, Islam wins, they are willing to brutalize everyone..

Breyer’s opinion would pave the way for any radical extreme political movement to simply ban anything by going on murderous sprees if they do not get there way.

It is an opinion which is a prescription for encouraging radicalism and terrorism.

I was wondering when someone would use the “fire in a theater” logic. Well, OK, as long as they are consistent with it. Meaning that if a bunch of folks here threaten to riot whenever a Bible or U.S. Flag is descreated....then it isn’t protected speech either. Goodness, we could get speaking about anything declared “unprotected” by simply rioting whenever someone says it.

You would think a SCOTUS judge would have more sense than to open that can of worms.

What a sack-0-shat.

The reason it’s “like yelling fire in a crowded theater” is because the muslims are threatening to start the fire. It’s not the book burning that’s dangerous - it’s the muslims.

This would be akin to me saying, “if you don’t eliminate the income tax, fire will fall on rain and you will suffer the mother of all battles”...

Then it would be claimed that allowing the income tax is akin to “yelling fire in a crowded theater”????

If it’s the case that violence is expected in retaliation than I demand the right to be violent when a bible or US Flag is burned.

In a more enlightened Age Breyer would have been thrown headlong from a cliff over water as an object lesson. When he attempted to regain dry land the children would have been given long staffs to push him back into the waves.

What happened if I punched every Democrat I heard talking about politics? Would they not have any right to free speech because they are inciting me to riot every time they speak?

So, um, burning korans bad, burning bibles good.

Isn’t this the govt deciding to protect ONE religion over all others? And then wouldn’t that be the establishment of state sponsored religion???

Judicial watch should jump all over this one, and if they don’t we need to seriously lock and load.

I’ll tell you what, if Breyer wants to start this debate, I will burn the Bible, the Torah and the Koran TOGETHER.

Then I will have a bonfire of EVERY flag from EVERY nation.

My faith isn’t in a book, my faith is in my heart. You can take a Bible from me, but you cannot take my savior.

You can burn my flag...but you cannot destroy my country.

And free speech means free speech for all. You cannot protect THEIRS and take MINE from me.
