Seems like the old adage of Judges ruling on the law (especially Constitutionality) are out of favor... They now have to put in their opinions on philosophy, Culture, Cost of Pajamas, Current Events, and anything else that strikes their fancy.

Maybe it’s time to change our system of justice...

This sort of totalitarianism was foreshadowed by two clauses in the Constitution that the Antifederalists complained about: the "General Welfare" clause and the "necessary and proper" clause, which taken together, the Antifederalists reasoned (correctly), gave Congress and the federal Government illimitable power over every thing the mind could conceive of, as a subject of legislation and litigation.

It's not like we weren't warned. This is Alexander Hamilton at work again -- "empire without the King" was always what he really wanted, his critics said, and any affection for liberty and republic were just a necessary pretense on his part.

His motive? It was "good for business" -- crony/access capitalism, again. He certainly did well at crony capitalism himself: he made a fortune speculating in gold and silver against the coin of his own Government.
