How much do you want to bet that, if he does go up for reelection, people will be making the excuse that “he doesn’t need to show proof of eligibility, because he was the president before, and that proves his eligibility.”?

OK, now I see the connection. Per se, lying about HI’s administrative rules is against Hawaiian statutes, which isn’t under federal jurisdiction. But you’re saying it’s in the service of perpetuating a fraud whereby Obama illegally draws a federal salary and has control over the spending of a vast amount of federal funds. In terms of prosecution, it’s far easier to build a case on raw facts—i.e., Fukino did or did not lie/misrepresent what Hawaiian required—than a case built around proving the motivation behind the lying. Unless there’s a smoking gun memo that nails down her frame of mind, I would guess that proving motivation would be pretty difficult. So you may be correct in a technical sense, but I’m guessing that even with an Attorney General with integrity in place, a federal prosecution against Fukino would be unlikely. JMO.
