God bless him! I hope this lawsuit is able to be cited, used as precedent for all of these idiot HOA's that deny people a reasonable use of their private propery, I don't care they signed the CC and R's. What began as a means to keep property values from going down due to neglect has turned into the most egregious misuse of non-power I've ever witnessed. I was never more glad as when I moved away from the HOA foisted on me, headed by an incredible idiot who thought a "home improvement" was something that made the yard pretty.

The people who brought this lawsuit should be stripped of their citizenship and deported to a place like Cuba or North Korea.
If someone in the USA is offended by a proper display of the Flag, then that person doesn't belong in this country.

Okay, #1, I know how folks feel about HOA's. But this guy MOVED IN knowing FULL WELL what the Rules & Bylaws were.
We've been in a HOA since 1978 with NO PROBLEMS, okay there was one. But anywho, there's a Packet everyone gets with the HOA bylaws before you close on the house.
If you sign, you agree - period.
And if you want a waiver for something, you go to the board meeting, simple as that.

Some people here seemed to have a problem with a Federal law superceding HOA rules.
There are several other examples of this that I assume they wuoldn’t have a problem with.
1. Many HOA covenants from the 60’s and earlier still say you can’t sell or rent your property to Blacks. A Federal law changed this. Are you saying the HOA covenants should still be valid?
2. Many HOA covenants from the 80’s and 90’s ban satellite dishes, or place such restrictions on them as to make them unusable. A Federal ruling changed this. Are you saying the HOA covenants should still be valid and you shouldn’t be able to put a Direct TV dish on your roof?
The reason so many outdated covenants are still in HOA agreements is that it can be very difficult to change the bylaws, depending on how they are written. In a subdivision of over 1800 homes I lived in in Houston it took a UNANIMOUS vote to change the bylaws. You couldn’t get 1800 Texans to agree on the 2nd coming, much less anything else.
