ORLANDO, Fla. -- A family that witnessed the death of killer whale trainer Dawn Brancheau in February is now suing SeaWorld, a lawyer representing them said.
Suzanne and Todd Connell were vacationing at SeaWorld with their 10-year-old son, Bobby, when they saw a 6-ton killer whale named Tilikum pull Brancheau into the water.
The New Hampshire family said they were only 30 feet from Brancheau when the incident happened. The family shot home video just moments before the trainers death.
The family has hired an attorney and is suing the park for negligence and damages from emotional trauma. Damages are not specified.
The family is being represented by Winter Park attorney John Overchuck. According to his website, he specializes in personal injury, wrongful death, product liability and negligence.
In an interview with WESH 2 earlier this year, the family said they were so traumatized by what they witnessed, they had sought counseling.

OSHA found SeaWorld to be in violation of three safety regulations and has fined the company $75,000 for allowing trainers to work with potentially dangerous animals. The same whale was involved in the death of another trainer in Canada.
I bought a circus ticket with a disclaimer cover performers deaths. Dose Sea World have such a disclaimer?

You can say that again. But you don’t have to now.
It’s pathetic that we need those types of disclaimers. I could take my kid to Wal*Mart and they could see someone get hit by a car. Who do I sue?
I’ll be glad when this litigious part of the American experience dies off when the country necessarily goes bankrupt. I’m hoping we are reborn with core values intact and the rest of the sh!t jettisoned.
But I'm sure mom and dad bought the kid an X-Box that he uses to "blast and kill folks" on a nightly basis for entertainment.
If I was the judge in this case, I force the family to watch the movie JAWS and toss the case.

When the incident occurred - a responsible parent would have removed their child and, if possible, not divulged the resulting death.
Another poster has asked how one could sue for witnessing an auto fatality on behalf of a child.
Consoling and guiding your children to face life’s adversities should not include making money from obscene, opportunistic lawsuits.
