New Evidence: Rubashkin Judge Should Have Disqualified Herself

Sholom Rubashkin, sentenced to more than the 25 years sought by prosecutors, says Judge Reade worked together on the case, pre-trial, with the prosecution team. Rubashkin, who was sentenced in June 2010 to 27 years in prison for bank fraud and related charges – two years more than the sentence sought by the prosecutors – now seems to understand why sentencing Judge Linda Reade seemed so partial against him. New documents produced in response to a Freedom of Information Act request show that Reade met frequently, well before the trial, with the very law-enforcement team that was actively planning the May 2008 raid on Rubashkin’s Agriprocessors kosher meatpacking plant. The documents also show that she participated in preparations for the raid, and expressed support for it. Rubashkin’s lawyers, who have now filed for a retrial, say Judge Reade should have been legally disqualified from presiding over his trial. Though she was required to disclose these meetings and her participation to defense lawyers, she did not make any such disclosures before presiding over the trial last year, said Nathan Lewin, his lead appellate counsel. The new evidence shows that Reade was not only regularly briefed on the raid preparations for more than six months beforehand, but also that she expressed her "support" for the raid, and directed that she be briefed on how it was to be carried out. "Without disclosing to defense counsel her meetings with the U.S. attorney and the support she expressed for the raid,” Lewin said, “she presided at Mr. Rubashkin's trial, and then immediately had him imprisoned, and sentenced him to two years more in prison than the prosecution requested." This is an EXTREMELY important lawsuit. And it has be VERY difficult to follow. This man was first attacked by PETA, then the unions, then the Feds, and they finally had a trial and he's in jail. I didn't believe the craziness of the charges until doing a lot of research, but it's just a total travesty of justice. Then this comes out! The Judge was part of the set-up and prosecution! I hope SHE ends up in jail.

What’s Reade’s background. Carter or Clinton appointed? PETA involvement suggests a far-lefty influence.

One thing which is a waste of time, however, is trying to get Reade to condemn her own self. She won’t. I don’t know why they’re bothering. If y’all think this is a simple railroad job and he doesn’t belong in jail, go right to the appellate court, don’t get into a cat fight with Reade.

Here in CA we have a judge ruling the people cannot change their Constitution -

To be fair, the defense (in the Prop 8 case) did not seem to be able to argue itself out of a paper bag. Combine that with a judge who thinks with the wrong head and you have a recipe for a disaster.

I hope Rubushkin nailed this crooked anti Semitic judge. Rubushkin is guilt but 27 years in prison is way ourt of proportion

I have to tell you that I was SURE that he was quilty, and didn’t even have a doubt that there was obviously something he had done early on and had been exaggerated.
After reading almost everything available I don’t think like that. He had a long term relationship with the bank, and he was only in the situation he was due to prosecurial zealotry.
(to be fair, even his lawyer says on the last bank loan he should do some time), but I can’t separate his desperate actions from how he GOT THERE!

It wasn't like they were in his basement, but as the top dog he certainly enabled his factory to employ them.

Somebody ought to pay for this besides the unemployed people in America ~ he's as good a target for punishment as anyone.

Raids at meat-packing plants across America found workers were illegal aliens using stolen or forged documents. The Rubashkins' plant even had a working meth lab. How convenient...and lucrative.... for the drug cartels.

Meat-packing companies claimed they didn't know the people they hired were illegal; that‘s when our govt came up with E-verify program.

Sen Menendez (D-NJ) opposes the e-Verify program. Menendez has a bill to stop these raids, claiming they "violate the rights of Americans of Hispanic descent" who can't produce a birth certificate or other documents to prove who they are.

Most Americans are required to prove to state govt they are legal Americans just to renew driver's licenses---or to get a passport----by coming up with several pieces of ID to prove who they are; some Americans have to pay to get new docs and make long trips to get the required docs. But Sen Menendez doesn't worry about OUR rights.

QUESTION Where do Menendez’ loyalties lie? When Menendez was under fire for using his elected office to get taxpayer money for a facility he owned and rented out, Menendez took refuge in the Dominican Republic, giving news interviews in Spanish. (Probably also visited his tax-free bank accounts).

QUESTION Where does Menendez get campaign funds? If Menendez is a paid agent of a foreign government, he should be subjected to US laws.

CONFLICT OF INTEREST ANYONE? Menendez is also connected to a lucrative lobbying group run by his girlfriend (a former aide he divorced his wife for). Menendez' lobbying group could easily facilitate sub rosa payments from foreign governments.

ITEM Sen “Reconquista Menendez opposes the e-Verify program. Menendez has a bill to stop these raids, claiming they “violate the rights of Americans of Hispanic descent” who can’t produce a birth certificate or other documents to prove who they are. “ If they are indeed Americans of Hispanic descent, they can easily prove it.

ITEM Mexican military officials running drugs across the border repeatedly into the US is also a matter to be looked into.

REFERENCE Agriprocessors produced Kosher meat and poultry in Iowa. It was founded by Brooklyn butcher Aaron Rubashkin, and managed by his son Sholom. In the affidavit filed as part of the 60-page application for a search warrant of the premises, details were revealed of the government's investigation including numerous allegations of health and safety violations, mistreating workers, and using controversial slaughter practices.

A former supervisor at the plant --identified as Source #1- told investigators that some 80% of the workforce was illegal. The source also said he believed rabbis responsible for Kosher supervision entered the United States from Canada without proper immigration documents. The rabbis are believed to be Israelis.

Sources related stories of fraudulent documents and Social Security numbers presented for employment. Several said they were aware of undocumented workers paid by supervisors in cash. The affidavit says the government has probable cause to believe that an Agriprocessors supervisor assisted workers in acquiring fake documents in exchange for a cut of the proceeds.

ITEM The Des Moines Register headlined that methamphetamine (AKA crystal meth) was discovered in active production at Agriprocessors (a substance that has been linked to Israeli suppliers).

In another notorious case, Rubashkin apparently "sold" $2 million worth of meat to Allou Healthcare (a company controlled by the Rubashkin's Hasidim brethren) Only problem is, Allou distributes health and beauty items------and is not in the food business. Authorities might consider that Allou paying Rubashkin for a product it did not sell might be a kickback, money laundering or tax evasion scheme.

Money laundering or tax evasion might be integrated into these bank fraud schemes----diverting millions of dollars in customer payments that were part of First Bank’s collateral and instructing an Agriprocessor employee to delete evidence of the scheme from the company’s computers........for which Rubashkin was arrested and charged with bank fraud.

The Rubashkins are related to NYC Rabbi Balkany who ripped off the US govt (taxpayers) of millions of dollars---and never served a day in jail. Balkany got tax dollars to build a "secular" daycare center attached to his synagogue----execept that no one but Orthodox religious were admitted (if at all). It was one big scam. Balkany is also close to Sen Joe Lieberman (I-Conn).

The judge only paid attention to those that wanted it overturned, and his own agenda was paramount. We need to pass laws that allow the will of the people to prevail, activist judges need to go.

Why do you insist when he was acquitted on this charge?
He was able to prove that the workers in question were hired on the basis of the SAME documents that they provided in order to open bank accounts, get library cards, get public assistance, and put their children in school!
His lawyers rightly proved that there was an injustice in holding him up to a higher (and illegal, btw) standard than government services.

The Meth lab was ONE of the incendiary claims that was added to the reason behind the plan on the LARGEST RAID IN US HISTORY, that, btw, the JUDGE helped draft up. There was no crystal meth lab found.
And just for a little background, the ‘controversial’ slaughtering technique is called ‘Shehita’, and is the manner in which all kosher animals are slaughtered, from the time of the giving of the Torah on Mt. Sinai. As kind and painless a manner as there is (unless you are a vegetarian, and follow the dictates of PETA.)

It is the worst case of corruption by a Federal judge that I have ever seen. There is an article about it kn the National Law Journal that I can’t post because I am on a mobile device. As Glenn Reynolds of Instapundit wrote, she should not only be impeached as a judge, she should ne disbarred as a lawyer.

I remember this raid well. This guy, Sholom Rubashkin, is guilty as ... 'hades'. Money Laundering, Embezzlement, running a Meth Lab, Harboring Illegals, etc, etc, etc. That he was not found guilty on all charges does not mean he was innocent, far from it.

Now, as to the Judge. In case you don't know it Federal Judges don't pick and choose which case they will try when those arrested by a Warrant he/she issues comes to trial. its all a matter of chance.

And as to a Federal Judge collaborating 'all the way' with a US Attorney as the article infers, hooey. They don't have the time. But they sure as heck will talk to them before the warrant is executed - to make sure what's in it is not exceeded. As they hate losing on appeal.

I also think it's pretty funny about the article moaning about Sholom's 27 year sentence and comparing the time with other convicted felons. That's like a convicted Murderer complaining,

'But I only shot him four times, not six. My Death Penalty Sentence isn't fair.'
