Silver lining - this is as close as you can get to the model test case for the Supreme Court. I don't know about that. Judge Napolitano, who is usually pretty accurate, thinks Kennedy would vote with the liberals on this one. Kennedy previously voted with them to invalidate a Colorado law that interfered with gay rights.
