Virginia law enforcement officials can ask the immigration status of those they stop or arrest, the state's Attorney General Ken Cuccinelli has ruled.
In a legal opinion written in response to a request from conservative Del. Bob Marshall (R-Prince William), Cuccinelli ruled that police officers and other legal authorities can look into the immigration status of anyone stopped or arrested.
A 2008 Virginia law requires that law enforcement check the immigration status of anyone taken into custody on suspicion of having committed a crime. Cuccinelli's opinion could expand such inquiries to those who have been stopped by law enforcement for a traffic violation or at a police checkpoint, for example.

In SW Texas, when I am stopped at checkpoints the 2nd statement made by the officer after saying “Howdy” is, “Are you a US citizen”. I see no problem with that, maybe it is because I am a white male and have nothing to hide.
Watch out Ken, Eric and his homies will be suing you next. You know the WAPO thinks this immigration thingy is just a pretext for racism. They may call you MACACA.

Attorney General Ken Cuccinelli
I love this guy. He’s taking on the “individual mandate” in ObummerCare, ClimateGate at UVA, and now he’s sticking his finger in the eyes of Obummer and Eric Holder over immigration policy.
I’d like to see Cuccinelli rise up the ranks. Like Sheriff Joe Arpaio, Cuccinelli has a spine of steel.
So cops theoretically can ask — but will their superiors ALLOW them to?
And to be in compliance with 8 USC 1034(e) you would have your Green Card on you - as is required by law. Since 1940 BTW.

I take strong objection to this statement. Being male & being white has NOTHING to do with immigration status. There are plenty of caucasian males here illiegally. They ought to be shown the door just like anyone else who has broken the law and entered our country.
Take the gender & race out of the equation. They are red herring.
Kaine signed an order for the State Police to not enforce that law if memory serves.
Last week i had to show the pharmacist a driver’s license to get cold

Kaine requested to rethink police authority
RICHMOND — Attorney General Bob McDonnell urged Gov. Tim Kaine (D) to rethink his decision not to seek additional immigration authority for state police investigating violent crimes. Kaine previously had dismissed an increased authority option, saying it would cost the state too much money.
“I am renewing my request to the governor in the interest of adhering to the rule of law and providing for additional public safety for our citizens of Virginia,” McDonnell said in a press conference Jan. 17.
McDonnell stressed the requested expanded powers for state and local police would pertain only to the investigation of violent crimes and would not be used to round up suspected illegal aliens.
