If the HOA doesn't have insurance to cover the legal fees no doubt the costs will be spread amongst the HOA members,including the truck owner.

Me too, in every way. Last time I bought a house, we told the realtor to not even both sending us listings in HOAs. I wouldn't live in one if you paid me to.
